The Architect’s Registration Act 2008 Section 7 (1) and Section 51 (2) b requires the Architects Registration Council of Botswana to issue a Code of Conduct and Ethics of the Profession which prescribes the standards of professional conduct, practice and ethics expected of the Registered Person registered under the Act.

Not all inability to meet the standards expected of a registered Architect by the Code of Professional Conduct, will necessarily give rise to disciplinary proceedings. A disciplinary order may be made against the Registered Person if they are convicted of a criminal offence even where that offence has no firm relevance to their ability to practise as a Registered Person.

Acceptance of this Code of Professional Conduct and Ethics of the Profession binds the Registered Person to the use of the adopted Tariff of Fees published by the Council. This applies to direct appointments and competition awards and for defined services subject to the Public Procurement Asset Disposal Act amendments.

Standard One - Be Honest and Act with Sincerity and Integrity Carry out your duties with honesty and integrity. Where a conflict of interest arises, disclose it in writing. Don’t make any statement which you know to be misleading, unfair or brings disrepute to the profession. If you receive payment or inducement for the introduction or referral of work, you should disclose to the client in writing.

Standard Two - Be Diligent In Your Work Carry out your work conscientiously. When giving advice, exercise impartial and independent professional judgment. Keep your client informed of the progress of work. Carry out your professional work without undue delay. If you are to act as both Architect and Contractor or supplier, inform your client of the need for an independent assessment. Do not accept a bribe, commission, discount or gift as an inducement to show favour.

Standard Three - Be Proficient Be competent in your duties. Inform your client that they can refer a complaint to the Council if your conduct or competence falls short. Keep your knowledge and skills relevant. Make appropriate arrangements for your professional duties. Ensure you have adequate professional, financial and technical resources. Safeguard all clients’ confidential information. Enter into a written agreement with your client. Informed your client in writing if your services have been sub-contracted.

Standard Four - Be Trustworthy Keep proper records of all money held by you which belongs to your client. Arrange for any interest accruing from a client account to be paid to the client.

Standard Five - Adequate Insurance Cover Have adequate and appropriate insurance cover for yourself, your practice and your employees. If you are an employed Architect, ensure that insurance cover is provided by your employer. Provide evidence that you have met the requirement expected of you.

Standard Six - Safeguard the Profession Ensure that your professional finances are managed responsibly. If you know that you have fallen short of these standards, report the matter to the Council. Notify the Council immediately if you: are convicted of a criminal offence; are made the subject of a court order disqualifying you from acting as a company director; fail to pay a judgment debt; are made the subject of a bankruptcy order;

Standard Seven-Do Not Discriminate Treat everyone fairly and in line with the law. Do not discriminate on the basis of disability, age, gender, sexual orientation, health, ethnicity, or any other inappropriate consideration.

Standard Eight - Deal With Complaints Promptly You must have a written procedure for prompt and courteous handling of complaints and provide this to clients. If appropriate, you shall encourage alternative methods of dispute resolution, such as mediation or conciliation.

Standard Nine - Comply With Regulatory Instruments of Botswana  You are expected to co-operate fully and promptly with the Council and within its specified timescales. You must notify the Council promptly and in writing of any changes in the details held about you on the Register, including your address.

Standard Ten - Promote your Services Honestly Promote your professional services in a truthful and responsible manner. Your primary responsibility is to your clients, but take into account the environmental impact of your professional activities. Advertising and promotion of your services shall be restricted to the name of the Practice and services offered. You shall ensure that commission of work related to existing projects has been formerly concluded with any previously appointed Registered Person and it is your duty to inform them in writing. You shall not accept a commission to review another Architect’s work without informing them in writing first. The revision of work is limited to an assessment of whether it is fit for purpose or not.
