Who we are Australia’s first national, independent regulator for all vehicles over 4.5 t GVM. Australia’s first national, independent regulator for all vehicles over 4.5 tonnes gross vehicle mass: an independent, statutory body based in Brisbane but with a national focus will evolve into a one-stop-shop for heavy vehicle road transport business with government across Australia, later in 2013. NHVR’s role: administer one set of laws for heavy vehicles under the Heavy Vehicle National Law (HVNL) minimise the compliance burden on the heavy vehicle transport industry and reduce duplication and inconsistencies across state and territory borders.

Key dates in the history of the reform process so far: July Council of Australian Governments (COAG) agreed to establish a single national system of laws for heavy vehicles over 4.5 tonnes - laws to be administered by an independent national regulator. February COAG named Queensland as the host jurisdiction and the corporate base for NHVR - Queensland the first to pass the HVNL, with other states and territories subsequently applying the HVNL in each jurisdiction. June NHVR Project Office opened in Brisbane to establish the new regulatory regime, build the Regulator’s corporate entity and facilitate transitional activities for jurisdictional service delivery areas. August Council of Australian Governments (COAG) signed Intergovernmental Agreement on Heavy Vehicle Regulatory Reform (with the exception of Western Australia). 21 Jan – NHVR opened for business initially managing NHVAS accreditation and PBS Scheme design and vehicle approvals (Release 1) Feb 2013 – HVNL Amendment Bill passed in Queensland Parliament 1 Sept 2013 – Ministers have agreed that the HVNL will commence from 1 September 2013. NOTE – We are on a reform journey. Already Release 1, Release 2, but we are planning a series of releases as new functions and services are available Timing Key messages Ministers have agreed that the HVNL will commence from 1 September 2013. What happened to 1 July 2013? Several factors are involved, including: Parliamentary processes in the participating states and territories. Finalisation of key national systems of the Regulator. Allowing more time for Police training.

When that happens the NHVR will be the heavy vehicle industry’s one-stop-shop for heavy vehicle road transport business with government. NHVR will deliver a comprehensive range of services and act as an information gateway for all heavy vehicle road transport business. Under a national approach to safety and compliance. NHVR will deliver: a national access management system more responsive Chain of Responsibility – including national investigations and prosecutions standardised regulations for mass, dimension and loading national inspection standards – including consistent and professional enforcement at the roadside nationally-consistent fatigue management laws – safer and more flexible programs. national coordination and management of auditing for mass-, maintenance- and fatigue-accredited operators nationally-consistent assessment and registration of industry codes of practice.

Access management – NHVR Role
Consider requests for access and make the final decision to grant a mass or dimension authority. Responsible for deciding whether vehicle conditions will be included in a mass or dimension authority. Responsible for ensuring that the restricted access vehicle may be used safety. The HVNL provides that the NHVR may only grant a mass or dimension authority if: the Regulator is satisfied that the use of heavy vehicles under the exemption will not pose a significant risk to public safety; each relevant road manager has consented to the grant; and any other consents required by law have been obtained or given. Access management – road manager consent
Road Managers may decide not to give consent if satisfied that the mass or dimension authority will, or is likely to: cause damage to road infrastructure; or impose adverse effects on the community from noise, emissions or traffic congestion; or pose significant risks to public safety arising from heavy vehicle use that is incompatible with road infrastructure or traffic conditions; and it is not possible to grant the authority subject to road or travel conditions that will avoid or significantly mitigate one of these relevant risks. Access management – vehicle conditions
a road manager may ask the NHVR to impose vehicle conditions to manage a relevant risk, being: potential damage to road infrastructure; adverse effects on the community arising from noise, emissions or traffic congestion; or significant risks to public safety arising from the use of the restricted access vehicle in a manner incompatible with road infrastructure or traffic conditions. NHVR manage application process – improved vetting Vehicle and route assessment guidelines Advice and technical support Decision making tools Ability to charge for route assessments extension of time for the road manager to decide whether to grant consent if consultation is required with another entity. (from draft Min guideline) An important role of the NHVR is to provide assistance to road managers in making access decisions. Road managers are expected to engage with the NHVR to determine how it can assist in making an access decision. It is not acceptable for road managers to refuse to consent to a grant of access because of a lack of resources if it has not been in contact with the NHVR to determine how it may assist in the access decision making process. Need a level of comfort from the CE and maybe Board about this point. Supporting Local Government Pre-approval agreements
Road managers outline scenarios where pre-approval is afforded under certain conditions NHVR able to provide permits to pre-approved vehicles without having to request separate consent and approval for each vehicle Aims to reduce the workload of road managers Notifications, in all cases, will be provided to road managers when a permit has been issued under a pre-approval agreement Agreements will include regular reviews Similar to Notices (which are another option) An example: a road manager may already have over-width loads up to 4.5 m wide operating on certain routes. Documents on a range of topics such as: Cranes Oversize, Overmass (OSOM) vehicles Freight-related Restricted Access Vehicles (RAVS) (e.g. B-doubles, road trains) Agricultural vehicles Ultimate aim is harmonisation around areas such as: Permit characteristics (e.g. is a 1 yr period permit appropriate for a 3-axle ATC? In what circumstances?) Conditions Initial aim is to consolidate current processes and policy and where possible harmonise

Improved national systems for permits and notices National Heavy Vehicle Registration Raise national regulatory effort in COR The work of the NHVR won’t finish with the launch od new services later in 2013. Among the initiatives on our Legislative Forward Work program is a national vehicle registration system. Although not currently part of that forward program, Commonwealth state and territory governments have committed to working towards a national driver licensing system.
