What is the Jeanne Clery Campus Security Policy & Crime Statistics Disclosure Act?
Referred to as the Clery Act, it is named after Jeanne Clery who was raped and murdered in her dorm room at Lehigh University in Her killer was another student. Her parents believed she would have been more cautious if she had known about other violent crimes which had previously occurred at Lehigh.
Congress agreed: the Clery Act, first enacted in 1990 and amended in 1998 and 2013, requires higher education institutions to report crime statistics to current and prospective students and employees.
The purpose of the Clery Act is to ensure that students and others are informed about campus crimes so they can make educated decisions.

The Clery Act requires that all institutions of higher education who receive Title IV funding gather crime information based upon the crime’s location, type of crime reported, year in which the crime is reported, and to whom the crime is reported, and provide this data to their campus community.
Clery divides the reportable geographic locations into three categories (1) on campus, (2) on public property within or immediately adjacent to the campus, and (3) in or on noncampus buildings or property that the institutions own or control.

As previously noted, the Clery Act requires that all institutions of higher education who receive Title IV funding gather crime information based upon the crime’s location, type of crime reported, year in which the crime is reported, and to whom the crime is reported, and provide this data to their campus community.

The Clery Act defines a Campus Security Authority as:
Any member of the campus police or security department;
Anyone who has responsibility for security other than the police or security department. This includes individuals who monitor access into a campus facility, event security, etc.
Any individual or organization specified in an institution’s statement of campus security policy as an individual or organization to which students and employees should report criminal offenses; and
Any official of an institution who has significant responsibility for student and campus activities.

Western Nevada College defines a Campus Security Authority as:
Any individual who is employed at, does business on, or volunteers at any university or college campus or sponsored event.

There are two types of individuals who, although they have significant responsibility for student and campus activities, are NOT campus security authorities under the Clery Act and are therefore exempt from this reporting requirement.
A person who is associated with a religious order or denomination, is recognized by that religious order or denomination as someone who provides confidential counseling, and is functioning within the scope of that recognition as a pastoral counselor;
A person whose official responsibilities include providing mental health counseling to members of the institution’s community and who is functioning within the scope of his or her license or certification. This definition also applies to professional counselors who are not college employees, but are under contract to provide counseling.

A CSA must report:
Any and all incidents, which may be criminal in nature that are brought to their attention.
A CSA report must include:
The type of crime reported to them;
The location of the crime (if known);
The date and time at which the crime occurred (if known);
The date and time at which the crime was reported to the CSA.

* Faculty and Staff are required to report crimes they become aware of through contact with other members of the campus community
Crimes should be reported the Western Nevada College Public Safety Department as soon as possible to ensure inclusion in the annual crime statistics and to aid in providing timely warning notices to the campus community when appropriate.
To report crimes contact the Western Nevada College Public Safety Department on duty officer at (775) Monday-Thursday 6:30a-11:30p/ Friday 6:30a-11:00p/Saturday 7:00a-5:00p (Excluding holidays). Contact 911 for emergencies.

Always Remember….
Be upfront with the individual that as a CSA you must report information regarding crimes for statistical purposes.
Let the person know about options for reporting to Public Safety:
Tell the person that he/she can report anonymously to WNC Public Safety.
A person who talks to you may not want to talk to the police – and does not have to – but tell the person you must forward the information.
If an individual is adamant about complete confidentiality, direct them to speak with a professional or pastoral counselor.
Just Get the Facts
WNC Public Safety Department will determine if a crime has occurred.
Your job is to get the information the person wants to tell you.
You are NOT a detective.
You do NOT have to prove what happened or who was at fault.
You are NOT supposed to find the perpetrator.

When in doubt, forward the information to WNC Public Safety Department.
It is important for WNC Public safety to be contacted with information regarding crimes immediately to determine if there is a current or ongoing threat to the campus community.
Remember, only WNC Public Safety can determine if a crime has been committed and/or if that crime is reportable under the Clery Act requirements.
