QUESTION: What is the recommended process for Texas Online Applications? ANSWER: From a legal standpoint Texas Online applications fall under Section , Election Code, which does not provide any mechanism for “rejecting” the update when the voter indicates an out of county response.   Rather, there are two portions of Election Code (included below) that deal with the outcome of this type of update: Under – The registrar should correct the voter record or, Under – The registrar should cancel a voter’s registration immediately upon receipt that the address is out of the county 11/15/2018

QUESTION: What is the recommended process for Texas Online Applications? ANSWER: As a practical matter, Section , Notice of Cancellation to Voter does not include this cancellation in the list of reasons that a Notice of Cancellation should be sent.  Thus, it is for this reason that we recommend the following workflow as a Best Practice, even though it is not strictly required according to statute. 11/15/2018

Texas Secretary of State Elections Division 11/15/2018 Texas Online Web Updates – Best Practice If the residence address on the Texas Online application indicates the voter’s new address is not within your county, then best practice is to reject the Texas Online Web application and send the voter the Notice of Rejection. We recommend printing the web application and forwarding it to the new county. The new county can send the voter an application to fill out and return. The voter registrar may cancel the voter who is already registered in the county and send the voter a Notice of Cancellation indicating they are no longer registered. 9 Statement of Residence
QUESTION: What is the purpose of a Statement of Residence? ANSWER: The purpose of the Statement of Residence is to allow voters whose names appear on the List of Suspense Voters, or who have moved within the county of the election a means to vote and to correct their addresses. The Statement of Residence form reflects the same information on the voter registration application, which allows the form to act as a voter registration application (or an update to their voter registration status). 11/15/2018

QUESTION: What must be included on a Statement of Residence? ANSWER: Section (c), Election Code outlines the requirements that must be included on the statement. This Subsection states the requirements as: (1) a statement that the voter satisfies the applicable residence requirements prescribed by Subsection (b); (2) all of the information that a person must include in an application to register to vote under Section ; and (3) the date the statement is submitted to the election officer. 11/15/2018

QUESTION: Who provides the Statements of Residence for use in the Election? ANSWER: Per Section (d), Election Code, the voter registrar is required to provide to the general custodian of election records a sufficient number of statements of residence for use in each election. There is no definition in the Election Code of what constitutes a “sufficient number.” As a rule of thumb, you may look at previous comparable elections to determine the number needed, or if no information is available, we recommend providing forms for at least 10% of the voters in each precinct whose name appears on the Suspense List. 11/15/2018

QUESTION: How does the registrar get completed Statements of Residence back? ANSWER: When delivering election supplies after the election, the presiding judge shall deliver Envelope Number 4, which contains the completed statements of residence, to the voter registrar. If the voter registrar is unavailable on election night, the presiding judge shall deliver the envelope to the custodian of election records, who shall in turn deliver it to the voter registrar. 11/15/2018

QUESTION: What do I do with Statements of Residence returned? ANSWER: Make the appropriate corrections in the registration records, including, if necessary, deleting a voter's name from the suspense list after receipt of a voter's statement of residence. The Voter Registrar, then, would correct the registration record and issue the voter a new certificate. (Section (a)(4), Election Code) Retain each statement of residence on file with the voter's voter registration application. (Section (e), Election Code) 11/15/2018

QUESTION: What Registration Date/Source Code is used? ANSWER: The registration date of the Statement of Residence for registration purposes is the date of submission to the presiding judge at the polling place. The registration date for a Statement of Residence submitted with a ballot by mail is the date of review by the early voting ballot board. The registrar would update the voter’s record using source code for Statement of Residence and an approval code for “Voter Initiated Change” to indicate the change was initiated by the voter. 11/15/2018

QUESTION: What if the address on the Statement of Residence is not within my county? ANSWER: When a new address provided on the Statement of Residence is in a Texas county other than the one in which the voter is currently registered, the voter registrar can use that statement to cancel the voter’s record and should copy the Statement of Residence for the voter’s Inactive File before forwarding the original Statement of Residence to the voter registrar in the new county. The new county voter registrar will be able to use the statement as a voter registration application. 11/15/2018

TASKS from SOS: A registrar may investigate as long as the registrar has reason to believe a person is not in fact eligible. To that end, there are several data sources resulting in task notifications for registrars. For nearly all tasks, the registrar may choose whether or not the data provided is enough to warrant an investigation. OTHER Sources: The registrar may use any lawful means to investigate whether a registered voter is currently eligible for registration in the county. Section , however, does not authorize an investigation of eligibility that is based solely on residence. 11/15/2018

ADDRESS CONFIRMATION - Each type of task has its own rules and regulations regarding the actions: Possible Felons: A registrar may send a Notice of Examination (initiating a 30 day response period before cancelling the voter). The registrar may (under (a)(3) immediately cancel a registered voter based on this task, but it is not recommended. Possible Deceased: A registrar may send a Notice of Examination, which is called Verification of Voter Status (initiating a 30 day response period before cancelling the voter), or cancel the voter immediately (under ) if the registrar determines that the voter is deceased. QUESTION: The voter is on Suspense, but I have information indicating the voter may be ineligible (deceased, felon, etc.) - Can I still investigate the voter? ANSWER: Yes. A voter's registration may not be canceled during an eligibility investigation if the voter's name appears on the suspense list unless the notice mailed to the voter indicated that the registrar had reason to believe that the voter is not eligible for registration because of a ground other than a ground based on residence. (Section (e), Election Code) 11/15/2018

QUESTION: What about Residency? How do I investigate the voter when I think they no longer reside in my county? ANSWER: Investigation does not apply to residency (Section , Election Code). If you believe the voter has moved, you may send the voter a Notice of Address Confirmation and place the voter on Suspense. See the “Suspense List Mass Cancellation Process” Mini-manual for more information on this process. It should be noted that different timelines apply to investigation (30 day response time set) as compared to issuing a Notice of Address Confirmation (voter remains in Suspense Status for at least two federal cycles). 11/15/2018

QUESTION: What is the impact to the voter when the Notice of Address Confirmation is sent? ANSWER: The voter will be placed on Suspense. QUESTION: What does it mean to say a voter is on Suspense? ANSWER: This is a Status of a Registered Voter. When a Notice of Address Confirmation has been issued to a voter to confirm the Voter’s Residence, the voter is placed on the Suspense List. QUESTION: How long does a voter remain on Suspense? ANSWER: The voter will remain on Suspense until the voter registers to vote in a new county, votes in the current county, or submits a new application or statement of residence in the current county. 41 Notice of Cancellation (16.036)
REMINDER: Cancellation Notices are sent to the mailing address on the voter’s registration application AND any new address known to the registrar. Cancellations notices must include the date and reason of cancellation, as well as a brief explanation of the voter’s right to challenge the cancellation and appeal the registrar’s decision. Cancellations should be sent not later than the 30th day after the date of cancellation. 11/15/2018

42 Reinstatements The Texas Election Code provides the voter registrar the ability to reinstate a voter under section if “the registrar determines after cancellation of a registration that the registration should not have been cancelled.” Keep in mind that under section “(d) A reinstatement of a registration takes effect immediately.” 11/15/2018

43 To reinstate a voter the registrar would:
Determine the reason the voter was cancelled - If the voter was cancelled because the voter requested the cancellation or moved to a different county, then the voter would not be eligible for reinstatement. In these instances, it is best practice to confirm through the active/inactive file or with the other county that the voter is, in fact, ineligible for reinstatement. 11/15/2018

44 To reinstate a voter the registrar would:
Determine Eligibility for Reinstatement - Once the registrar determines the reason the individual was cancelled, the registrar would then need to determine whether or not the voter is eligible for reinstatement Reinstate Voter (if eligible) - It should be noted that reinstatement simply means that the voter registrar is reinstating the voter to the same state the voter was in prior to being cancelled. 11/15/2018

4. Send Notice to the Voter of Reinstatement - Once a voter has been reinstated, the registrar is required, under section , to “deliver written notice of the reinstatement to the voter. The notice shall be delivered by mail to the mailing address on the voter's registration application and to any new address known to the registrar. File Response in Active Voter File - A copy of the voter’s response should be filed with the voter’s application The registrar must “enter the date of and reason for the reinstatement on the voter's registration application and duplicate registration certificate, make any appropriate corrections in the registration records, and take any other action necessary to give effect to the reinstatement” in accordance with (c) of the Election Code. 11/15/2018

48 Responsibilities of a VR
Per Section (b), Election Code, if, after canceling a voter's registration under the Mass Cancellation of Suspense Voters, the registrar receives a Statement of Residence executed by the voter at an election held before the date the voter's registration was required to be canceled, the registrar shall reinstate the registration. Keep in mind that a reinstatement takes effect immediately, and the registrar is required to enter the date of and reason for the reinstatement on the voter's registration application and duplicate registration certificate, make any appropriate corrections in the registration records, and take any other action necessary to give effect to the reinstatement. 49 Reinstatement Vs. Reregistration
When a voter is reinstated, the voter’s record is made active in the original state the record was in at the time of cancellation, with one exception (if applicable). If a Mass Mail Out has occurred after the cancellation of the voter record, the voter’s Valid From Dates will reflect the current biennial cycle. If a voter was properly cancelled and is reregistering in the county, then the voter record is not eligible for reinstatement and would be treated as any new voter to the county – receiving new Valid From and EDR dates. 11/15/2018

As such, all lists should be pulled from TEAM for use in elections. The OLRV takes into account the EDR of a person. As a practical matter, the only way to produce an OLRV in TEAM is to first set up an associating election for the list to key off. The OLRV is the list that should be provided in preparation for an election. 11/15/2018 OLRV Logic The OLRV will produce all the voters in the district and/or districts, assigned to the specific election selected when requesting the OLRV list. Whether a person appears on the list is dependent upon the EDR of the Voter and the Districts assigned to the election. Valid From Date determines what information is displayed- Changes to a voter record, such that their name, address, etc. is modified and has a valid from date that is greater than the date of the election should not be shown. This date should be the date the last list was run. The supplemental list keys off the status change date, meaning that it will provide any new registration or information on a registration in which the status has changed. Texas Secretary of State Elections Division 11/15/2018 Forms and Contents of List Section Each OLRV and Supplemental List must: Contain the voter’s name, date of birth and registration number as provided by the statewide computerized voter registration list Contain the voter’s residence, unless the individual is covered under confidentiality Be arranged alphabetically by voter name; and Contain the notation “S” for voters in a Suspense Status.
