4 JAX/Norfolk Purpose To inform you that veteran-owned small businesses enjoy an advantage when competing for federal government contracts

5 Congress’ “Rule of Two”
Competition for federal contracts should be limited to veteran-owned small businesses when the contracting officer concludes that: At least two such businesses will bid on the contract The award can be made at a fair and reasonable price that offers best value to the United States.

6 Executive Order 13360 Requires Federal procurement officials & prime contractors to provide Small businesses owned & controlled by Veterans or Service- disabled Veterans Maximum opportunity to participate Bidding of federal contracts and subcontracts

7 Government Contracts May be awarded as Before award of a contract
sole-source award set-aside award based on competition restricted to these firms Before award of a contract must be registered in the System for Award Management at

8 #GOALS Statutory Goals set by Federal Executive agencies for total value of a contract include 23% of prime contracts for Small Business (SB) 5% of Prime/Subcontracts for women-owned SB 5% of Prime/Subcontracts for Disadvantaged SB 3% of Prime/Subcontracts for HUBZone SB 3% of Prime/Subcontracts for Service-Disabled veteran- owned SB

9 Service-Disabled Veteran-Owned Small Business Program
Veteran Entrepreneurship and Small Business Development Act of 1999 Annual Government-wide goal of not less than 3% of the total value of all prime/sub-prime contracts Veterans Benefits Act of Dec 2003 Establishes a procurement program for Service-Disabled Veteran-Owned Small business concerns (SDVOSBC) Provides procurement agencies with the authority to set aside acquisitions for SDVOSBC Sole source awards in special cases

10 Eligibility for SDVOSBC Program
The business must be small according to SBA Standards The Veteran must own 51% of the business Have a service-connected disability determined by the DVA or DoD The Veteran must control the management and daily operations The Veteran must hold the highest officer position in the business

11 Certify your Military Service and Disability
To be considered a Veteran DD214 Certificate of release Validate your Disability Letter from VA Discharge Paperwork from Branch of Service stating you are disabled Percentage of Disability (0-100%)…. Self-Certifying Process No verification process is required!!! A Contracting Officers could review contracts for fraud

12 Set Aside Contracts A Contracting Officer may award if
SDVO is approved to bid on contract Two SDVO will bid against each other Priority to SBA 8(a), HUBZone, SDVOSBC before setting money aside for any other SB Award made at a fair market price Cannot Set-Aside if Prison Industries Inc, or Javits-Wagner O’Day Act Current 8(a) Participant (getting money soon) SBA has accepted the requirement for performance under 8(a) 8(a) SBA’s Business Development Program HUBZone is a United States Small Business Administration (SBA) program for small companies that operate and employ people in Historically Underutilized Business Zones (HUBZones). The HUBZone program was created in response to the HUBZone Empowerment Act created by the US Congress in 1998.[1] Based on the Act, small businesses will be designated as HUBZone certified if they have the following criteria:

13 Sole Source Contracts A Contracting Officer may award if
SDVO is allowed to bid contract but cannot use set-aside contract No expectation of two bidding SDVO’s The anticipated award price will not exceed $5 million for manufacturing requirements Or $3 million for all other requirements Award can be made at fair market value
