The Americans with Disabilities Act (ADA)
Prohibits discrimination and guarantees that people with disabilities have the same opportunities as everyone else. Employers are required to provide equal employment opportunities to qualified individuals with disabilities in every aspect of employment. To be protected by the ADA, one must have a disability, which is defined by the ADA as a physical or mental impairment that substantially limits one or more major life activities, a person who has a history or record of such impairment, or a person who is perceived by others as having such an impairment. The current version of the ADA includes changes made by the ADA Amendments Act of 2008,which became effective on January 1, 2009 and is referred to as the ADAAA. What is the ADA? The Americans with Disabilities Act (ADA) was signed into law on July 26, 1990, by President George H.W. Bush. The ADA is one of America's most comprehensive pieces of civil rights legislation that prohibits discrimination and guarantees that people with disabilities have the same opportunities as everyone else to participate in the mainstream of American life -- to enjoy employment opportunities, to purchase goods and services, and to participate in State and local government programs and services. Modeled after the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, religion, sex, or national origin – and Section 504 of the Rehabilitation Act of the ADA is an "equal opportunity" law for people with disabilities. Employers are required to provide equal employment opportunities to qualified individuals with disabilities in every aspect of employment, including but not limited to the job application process, the essential functions of a job, and benefits. To be protected by the ADA, one must have a disability, which is defined by the ADA as a physical or mental impairment that substantially limits one or more major life activities, a person who has a history or record of such impairment, or a person who is perceived by others as having such an impairment. Our ADA Workplace Solutions gives you information and guidance including an ADA Coach, It’s a proactive approach that can help your employees stay at work instead of going out on disability. However, if an employee needs to be absent as a part of an ADA accommodation, your ADA Coach is here to help connect you with resources to support the leave administrative process. We also offer ADA Leave Administration. That includes the following activities: Sends notification letters and forms Gathers required forms and information Confirms with you whether additional leave can be approved as a reasonable accommodation Tracks approved ADA leave time Provides ADA leave activity reports Help in coordinating getting vocational rehab resources if needed
