6 She was denied her teaching degree
Stacey Snyder was 22 at the time of the photo and was completing her student teaching. According to court records this was just one in a long list of unprofessional and inappropriate behavior. Plaintiff was “overly familiar,” with students and “evidenced some aspects of poor judgment during the Semester, especially in regard to one specific instance.” Snyder also wrote about her cooperating teacher in a negative way on her page. Snyder sued, but a federal court found no First Amendment violation. Applying thePickering case, the court ruled that her MySpace postings dealt only with purely personal matters, not issues of public concern. Washington Post. December 3, 2008.

10 In Pickering v. Board of Education, the Supreme Court held that it’s not a First Amendment violation to dismiss teachers for what they say or write, if their speech involves merely personal things. You are a public figure and a state employee and as such do not have the same 1st amendment rights as all citizens. Pickering involved a Township High School teacher who was dismissed after writing a letter to a local newspaper which criticised how the Township Board of Education and the district superintendent had handled past proposals to raise new revenue for the schools. The claim that his writing the letter was protected by the First and Fourteenth Amendments was rejected by the Board of Education. He appealed the Board's action to the Circuit Court of Will County and then to theSupreme Court of Illinois, which both affirmed his dismissal. The Supreme Court of the United States agreed the teacher's First Amendment right to free speech were violated and reversed the decision of the Illinois Supreme Court.
