Accountability Board Recognizing EEO Issues Issues that “Cross the Line” As committee members, you should have completed the eLMS courses and viewed the EEO video entitled “ Understanding Your EEO Rights and Responsibilities”. There may be some issues that you will be asked to work that are beyond the scope of the PSP and fall within the guidelines of the EEO program. Some issues will be borderline and these issues need to be recognized. Issues that cross the line are those that any reasonable person would recognize.

3 PSC Responsibilities As PSC members, you are NOT trained EEO counselors and you are NOT expected to be. Learn to recognize potential EEO complaints. Ask the right questions during the process. Know who to call; know the timelines. As committee members, you should have completed the eLMS courses and viewed the EEO video entitled “ Understanding Your EEO Rights and Responsibilities”. 5 Harassment Insulting words or phrases, slurs, stereotyping, intimidating or hostile acts. Material placed on walls or bulletin boards or circulated in the workplace that insults, denigrates, or offends. Actions that threaten or result in physical contact such as hitting, shoving, pushing, and/or other acts of aggression. As committee members, you should have completed the eLMS courses and viewed the EEO video entitled “ Understanding Your EEO Rights and Responsibilities”. There may be some issues that you will be asked to work that are beyond the scope of the PSP and fall within the guidelines of the EEO program. 6 Sexual harassment is unlawful.
Sexual harassment involves unwanted or unwelcome sexual advances, requests for sexual favors, and other verbal or physical harassment of a sexual nature. Offensive remarks about a person’s sex, or any other type of harassment that is based on a person’s sex, is also considered sexual harassment. As committee members, you should have completed the eLMS courses and viewed the EEO video entitled “ Understanding Your EEO Rights and Responsibilities”. There may be some issues that you will be asked to work that are beyond the scope of the PSP and fall within the guidelines of the EEO program. 7 Accountability Board The Board was established in July 1998 to address allegations of sexual harassment, misconduct of a sexual nature and related reprisal. As of July 1, 2000, the Board’s scope was be expanded to also include all allegations/incidents of verbal, written, graphic or physical harassment and other misconduct that creates or that may reasonably be expected to create an intimidating, hostile or offensive work environment based on race, color, religion, gender, sexual orientation, national origin, age or disability. 8 Accountability Board The scope of the Accountability Board does not include allegations of discrimination involving: Non-selections Disciplinary Actions Promotions Performance Management Other Personnel Actions As committee members, you should have completed the eLMS courses and viewed the EEO video entitled “ Understanding Your EEO Rights and Responsibilities”. 9 Accountability Board Allegations of sexual harassment that may include unwelcome sexual advances, requests for sexual favors, or verbal or physical conduct of a sexual nature when submission to, or rejection of, such advances or requests that: Are made a term of employment; or Are the basis for employment decision; or Unreasonably interfere with an individual's work performance or create an intimidating, hostile, or offensive work environment. As committee members, you should have completed the eLMS courses and viewed the EEO video entitled “ Understanding Your EEO Rights and Responsibilities”. There may be some issues that you will be asked to work that are beyond the scope of the PSP and fall within the guidelines of the EEO program. 10 Accountability Board Allegations or incidents of misconduct of a sexual nature that include behavior that fall short of the legal definition of sexual harassment but impact on job performance, or are not conducive to a professional work environment. There may be some issues that you will be asked to work that are beyond the scope of the PSP and fall within the guidelines of the EEO program. 11 Crossing “The Line” PSP committee members need to recognize when an issue “crosses the line”. PSP cannot accept issues that cross the line. PSP cannot accept issues when management has been notified or for management-initiated issues. 12 Questions to Ask Is Management involved?
Is the offending party aware of the problem? Have steps been taken to mitigate or solve the problem? As committee members, you should have completed the eLMS courses and viewed the EEO video entitled “ Understanding Your EEO Rights and Responsibilities”.
