These systems have been around for a while and are basically a digital version of driver logs with limited link between truck’s ECM
Will be required by the vast majority of trucks built after 2000 that currently keep paper logs
Motor carriers have until December 2017 to purchase and implement AOBRD
ELD (Electronic Logging Device)
Similar to AOBRD but requires a link between the transponder and truck ECM
More rigorous data requirements than AOBRD including engine status and VIN
Fleets with AOBRD have until December 2019 to implement ELD

7. Road Safety Benefits of ELD
Drivers in serious violation (e.g., driving over prescribed limits) of the HOS regulations are 45% more likely to be involved in an accident than those who are in compliance.
Drivers with patterns of non-compliance were found to be at 90% greater risk of collision.
Carriers that have a pattern of serious hours of service violations have a crash rate 90% higher than the average.

The ELD mandate is intended to have a direct and immediate impact on curbing this behavior!

8. Who must comply with the ELD Rule?
Commercial Motor Vehicles s defined 
in 49 CFR 390.5
≥ 10,001 pounds GVWR

More than 8 or 15 passengers

9. Common Exemptions
The ELD rule allows limited exceptions to the ELD mandate, including:
Drivers who operate under the short-haul exceptions may continue using timecards; they are not required to keep RODS and will not be required to use ELDs.
100 air‐mile radius drivers may continue to use  timecards, as allowed by §395.1(e)(1
150 air‐mile radius non‐CDL freight drivers may  continue to use timecards, as allowed by  §395.1(e) (2)
Drivers who use paper RODS for not more than 8 days out of every 30-day period.
Drivers who conduct drive-away-tow-away operations, in which the vehicle being driven is the commodity being delivered.
Drivers of vehicles manufactured before 2000.

10. Motor Carrier Responsibilities
Must properly administer an ELD system and maintain confidential usernames and passwords for all drivers and driver support personnel and ensure that ELD records and accounts are protected
Portable ELD systems that use a smartphone or tablet must display the device in a fixed-mount position that is visible to the driver when seated in the driving position
Each driver must have ELD instructions and blank log sheets

11. Motor Carrier Responsibilities, Cont’d
Once ELD hours of service records are certified and received from the driver, the motor carrier may propose record edits to the driver.
Edits must describe each change or addition made to a record that is edited after it was submitted to the motor carrier
The driver may accept, change, or reject the edit and recertify the log
ELD system must maintain the original record and changes that were made to it
Must fix a non-functioning ELD within 8 days of discovering the malfunction or receiving written notice from the driver about the malfunction

12. Driver Responsibilities
Record and maintain standard hours of service records within the ELD
Within certain limitations, can edit none driving hours of service events and information
Special driving categories for personal conveyance (PC) and yard moves (YM) must be selected before use and deactivated following use
Within 24 hours of determining that an ELD is malfunctioning, the driver is required to notify the motor carrier in writing

21. What is the latest on the ELD Mandate?
The U.S. House of Representatives defeated an amendment late Wednesday (Sept. 6) that would have restricted funding for the ELD mandate until at least Sept. 30, The amendment was added to an appropriations bill by Rep. Brian Babin (R-TX). It was voted down
There is a still a standalone bill (H.R.3282-Babin) that would delay the mandate for two years, but despite at least 45 co-sponsors, it still has not been moved to the House floor for any vote.

22. Why do it now? Technically, you don’t have to yet? But….
Technology implementation will be transformational to business.
We know it’s coming better to be prepared.
Electronic log books are MUCH more efficient.
