3 Federal Legislation Ruled legal in all states on June 26th, 2015, except in American Samoa as well as some Native American land. Ruled in Obergefell v. Hodges which declared the states’ ban of same- sex marriage unconstitutional and in direct violation of the 14th amendment in regards to equal protection clauses. Prior to Obergefell v. Hodges, over 40 states legalized same-sex marriage due to the case United States v. Windsor which declared it illegal to only allow the title of “spouse” as well as the approval of a marriage license to opposite-sex couples in accordance to 5th amendment rights. Prior to United States v. Windsor, only 12 states plus D.C. had same- sex marriage legal.

4 DOMA In 1996, the Defense of Marriage Act (DOMA) was passed to allow states more freedom in denying same-sex couples the same rights as opposite-sex couples. Section 2 of DOMA stated that if one state recognized the validity of a marriage, no other state was obligated to do the same. Section 3 defined marriage as a union between a man and a woman, without any mention of same-sex partner.

5 State Legislation 9 counties in the US still refuse to give marriage licenses with one in Texas, and the other 8 in Alabama. However the counties in Alabama don’t issue licenses period, with these counties follow state law from 1961 which allowed counties to shut down the distribution of marriage licenses period to uphold segregation.  The decision to continue this practice was done in 2013 after the Obergefell case. Until 2016, some counties in Kentucky also refused to issue marriage licenses to same-sex couples.

6 State Legislation Cont.
The first state to legalize same-sex marriage on its own was Massachusetts in Nov. 18th, 2003 and became effective May 17th, The second was California on May 15th, 2008 with the ruling becoming effective June 16th, 2008. States which legalized same-sex marriage prior to federal ruling were: Massachusetts, California, Connecticut, Iowa, Vermont, New Hampshire, D.C. New York, Washington, Maine, and Maryland
