2 Legal regulations of European Union
Council Directive 1999/31/EC of 26 April 1999 on the landfill of waste – directive has set criteria of EU for landfilling - Slovak Republic has adopted this directive and has implemented to the legal regulations of Slovak Republic Council Decision of 19 December 2002 establishing criteria and procedures for the acceptance of waste at landfills pursuant to Article 16 of and Annex II to Directive 1999/31/EC

Act No. 223/2001 Coll. on Waste and on Amendment of Certain Acts as later amendment Order No. 283/2001 Coll. of the Ministry of the Environment of the Slovak Republic of 11 June 2001 implementing certain provisions of the Act on Wastes

4 Landfill definition Act on waste Art. § 2 (18) – Landfill definition
A landfill site shall mean a place with an installation for waste disposal where waste is permanently deposited on or into land. A landfill site shall also mean a place in which waste generator effects disposal of its wastes in the place of their production (internal landfill) as well as a place, in which is permanently, i.e. for a period exceeding a year, used for temporary waste depositing. A landfill site shall not mean an installation where waste is deposited for the purpose of its treatment prior to its further shipment to a place where it is to be treated, recovered or disposed, if the time of its depositing prior to its recovery or treatment – as a rule – does not exceed three years, or the time prior to its disposal does not exceed one year. Art. § 81a – interim provisions – Until 15 July 2009 must each landfill fulfill all requirements on landfills under the Act and of the generally binding legal regulations issued for its implementation and to prepare and submit for approval a plan of the landfill adaptations including a time schedule for achieving compliance with all requirement on the landfill - i.e. to be in comply with landfill directive

5 Classes of landfills Article 25 Order No. 283/2001 Coll. – Landfills shall be classified into the following classes: Landfills for inert waste Landfills for non – hazardous waste Landfills for hazardous waste The basic princip is that for each landfill is possible to accept only stipulated waste

6 Order No. 283/2001 Coll. of the Ministry of the Environment of the Slovak Republic – this Order regulates: Art. 24 – selection of localites for waste landfills - the basic criteria which shall be accept are the following criteria: secure distance, protection of nature, landscape and cultural heritage, the acceptable burden on the territory, conclusions from an environmental impact assessment, geological, hydrological, hydrogeological conditions.

Art Requirements for sealing waste landfills – each landfill must be sealed in such a way that a geological barrier or an artificial base sealing layer for the landfill and top sealing layer for the landfill result in protection of the soil, surface water and groundwater after closure. In many case the basic parts off a landfill consist of: The landfill base The mineral layer – shall be no less than 0,5 m thick with permeability of kr = 1,0 x HW kr = 1,0 x 10-9 NHW kr = 1,0 x 10-7 IW The layer of high – density polyethylene foil (HDPE) – 2,5 mm thick for HW - 1,5 mm thick for NHW The geotextile The draining layer – 0,5 m thick The Waste

Art. 27 – draining and collection of leachate and collection of landfill gas The drainage layer – 0,5 m thick The drainage pipelines Art. 28 – constructional and technical requirements for landfill construction – e.g. – an information board, a fence and lockable gates, a weighing – machine and other necessary installations Art. 32 – landfill operation – during the landfill operation is important to minimise bad effects of the landfill on the environment Art. 34 – closure and after – care procedures - landfill has to be monitoring and control 30 – 50 years after issuing the certificate of closure of the waste landfill.

Conclusion: The basic criteria for the acceptance of waste at landfills are established in: Art. 32 Order No. 283/2001 Coll. Art. 18 Act on waste – it is prohibited to perform landfilling of: 1, Liquid wastes, 2, Waste which, in the conditions of a landfill, is explosive, corrosive, oxidising, highly flammable or flammable 3, Infectious waste from medical and veterinary establishments, 4, Used tyres and shredded used tyres, excluding tyres that may be used as construction material for building a landfill, bicycle tyres and tyres with an outside diameter above 1,400 mm 5, Wastes where the contents of injurants exceeds limit concentration values under Annex 5 Annexes 5 and 6 to Act No. 223/2001 Coll. : 1, Limit Concentration Values of Harmful Substances in Waste 2, WASTES REQUIRING STABILISATION PRIOR TO LANDFILLING

12 Current situation in Slovak Republic
Registration notes for landfill which shall be kept by landfill operators has to be completed for a period of one calendar year and has to be sent to the appropriate authority until 31 January of the following year.
