20 Waivers Overview (Almost) All waivers apply to ARRA funding
ETA will undertake a policy review of all waivers States need to provide a strong justification for full consideration of waiver requests

21 Not Applicable to ARRA Waiver of funds transfer limit between Adult and Dislocated Worker programs Waiver of the limitation on the use of funds for capitalization of businesses. Waiver to permit the state to use rapid response funds to conduct statewide activities including Incumbent Worker Training (IWT). States may request for ARRA if IWT is part of lay-off aversion strategies

22 New Waivers Waiver related to WIA procurement requirements for youth summer employment providers Waiver of WIA section 123 for purpose of: Expanding existing competitively procured contracts. Expedited limited competition to select service providers. Does not waive state/local procurement laws or OMB requirements (29 CFR Parts and ) Only applies to ARRA funds and Summer 2009

23 New Waivers Waiver related to WIA procurement requirements for youth summer employment providers In addition to the required WIA elements, the waiver request must: Describe reasonable accountability safeguards against unfair procurement practices Assure compliance with state and local procurement laws and policies Describe how states will publicly announce summer employment providers, consistent with the emphasis on transparency in the Recovery Act

24 New Waivers Waiver of performance measures for youth who participate in work experience only Permit states to use work readiness indicator as only performance indicator for out-of-school youth age who participate in work experience only beyond the summer months Only applies to ARRA funds and only for the first six months following the summer of (i.e., October to March).

25 New Waivers Waiver of performance measures for youth who participate in work experience only In addition to the required WIA elements, the waiver request must address continued service plans for participants served under the waiver, such as: a transition to the WIA Adult program (i.e., co-enrollment in WIA Adult services) or further education and training activities under WIA or Recovery Act-funded youth services.

26 New Waivers Waiver for program design flexibility for youth who participate in work experience only Permits use of summer employment design flexibility for out-of-school youth age who participate in work experience only beyond the summer months: Waiver of requirement to make all 10 program elements available Flexibility in providing the required 12 months of follow-up services Flexibility to determine appropriate type of assessment and Individual Service Strategy

31 Waivers: Process Details
If states currently have these waivers and request extension on April 15th, they are not required to submit on June 30th: Waiver to permit implementation of and reporting only for the common measures Waiver of the prohibition on the use of Individual Training Accounts for youth Waiver of the time limit on the period of initial eligibility for training providers. These waivers approved for all of PY based on April 15th request for extension

32 Waivers: Required Elements
Waiver plans must: Identify statutory and/or regulatory requirements for which waiver is requested Describe the actions the state/local area has undertaken to remove state/local barriers Describe the goals of the waiver, how goals relate to Strategic Plan goals, and expected programmatic outcomes Describe individuals impacted by the waiver Describe the processes used to monitor implementation, provide notice to any local board affected by the waiver, provide affected local boards opportunity to comment, and ensure meaningful comment Requirements described in WIA at section 189(i)(4)(b) and in the WIA regulations at 20 CFR (c)

35 Question: State Plans Our state has undergone a major reorganization resulting in changes in policies and strategies, and there will be significant revisions throughout the State Plan.  Do we need to do two modifications?

36 Question: State Plans Is there any requirement that Local Plans be on the same planning cycle as the State Plan, i.e., July 1, 2009 through June 30, 2010?

37 Question: Waivers For the three waivers that do not apply to Recovery Act funding, can states ask for an extension of these waivers to continue for formula funding into PY 2009?

38 Question: Waivers My state will be requesting an extension of several waivers, but we will also be submitting requests for waivers that are new to the state.  We may not have all these new waiver requests ready for submission by the April 15th deadline.  Can we submit these new waiver requests later?
