5 Council Regulation (EC) 2135/98
Introduces Basic Provisions for a new type of Digital Recording Equipment with Mass Memory (VU) and Smart Cards Amends Council Regulation 3821/85 on Recording Equipment in Road Transport Mandates the Commission to define Technical Specifications for the Digital Tachograph, assisted by Member State Committees © International Road Transport Union (IRU) 2005

7 Implementation To help Member States Implement the Digital Tachograph, the Commission has supported and still supports several Projects: Card Issuing Working Group Implementation of the Digital Tachograph (IDT) Security Key Certification System Tachonet Monitoring of the Implementation of the Digital Tachograph (MIDT) © International Road Transport Union (IRU) 2005

8 Introduction Time Schedule
Regulation (EC) 2135/98 – Article 2: 24 months from the Date of Publication of Annex 1B, vehicles put into service for the first time must be fitted with the Digital Tachograph 21 months from the Date of Publication of Annex 1B, Member States shall take measures to ensure that they are able to issue Driver Cards In the event that 12 months after the publication of Annex 1B, EC Type Approval has not been granted to any item of Recording Equipment (VU’s + cards), the Commission shall Propose to the Council (and the European Parliament) an extension of the 24 and 21-month deadlines © International Road Transport Union (IRU) 2005

9 Consequences of the Time Schedule
Given that Annex 1B has been published on 5 August 2002: Digital Tachographs shall be fitted in new vehicles by 5 August 2004 Member States shall be able to Issue Cards by 5 May 2004 VU’s and Cards shall be Type Approved by 5 August 2003 © International Road Transport Union (IRU) 2005

10 Delays Situation Summer 2003:
No Type Approved VU and/or Cards by August 2003 Statement Tachograph Manufacturer: “Type Approval will be obtained before the end of 2003” Commission decides not to propose a formal extension of the Introduction Dates © International Road Transport Union (IRU) 2005

11 Delays Informal Meeting with Industry September 2003:
First Type Approved VU’s and Cards are expected in March / April 2004 Vehicle Tests are expected to start in January 2004 and finish by January 2005 Installation of the Digital Tachograph in New Vehicles is expected by Summer 2005 © International Road Transport Union (IRU) 2005

14 Legislative Proposal June 2004: Council unanimously reaches Political Agreement to include new introduction dates in the proposal on the harmonisation of Social Aspects in Road Transport (3820/85) Political Agreement accepted by the Commission December 2004: Political Agreement is adopted as a Common Position April 2005: European Parliament adopts Amendments on the Introduction Dates © International Road Transport Union (IRU) 2005

15 Current Situation Tachograph Manufacturers can supply the market with the volumes needed Vehicle Manufacturers have started production of vehicles equipped with a Digital Tachograph Operators have already ordered vehicles fitted with the new equipment Drivers, Operators and Control Officers receive Training Programmes Member States are issuing Tachograph Cards Tachonet is Operational Security Key Certification System is Operational © International Road Transport Union (IRU) 2005
