2 PURPOSE Computing the eligibility of under-trial prisoners to apply for bail under sections 436/436A Cr.P.C. Prevention of illegal & unnecessary detention of under- trial prisoners

3 WHAT IT DOES Evaluates the total period of detention of UTPs on real- time basis Informs the user about eligibility of prisoners to apply for bail under 436/436A Cr.P.C. Informs the user where there have been over-stays of prisoners beyond the maximum period of detention prescribed for the offence charged.

5 HOW TO INCORPORATE Incorporate it into the existing prison/prisoner management software:- PMS: NIC – Delhi, West Bengal PMS: Aims Global Ltd. – Maharashtra PRISMS: Goa Electronics Ltd - Goa Where Prison Management Software is not present, install it in each prison. Requirements are:- Computer Data Input person Availability of data such as name, father’s name, age, date of admission, offence charged with etc.

6 HOW TO INCORPORATE… It may also be installed at the judiciary level. The requirements are the same as those in prison i.e.:- Computer Data Input person Data such as name, fathers name, age, date of admission, offence charged with etc.

7 Reports generated List of prisoners eligible to apply for bail u/s 436 Cr.P.C. List of prisoners who have served one half of the maximum term of sentence s/he would have served had s/he been convicted & are eligible to apply for bail u/s 436A Cr.P.C. List of prisoners who have served maximum term of sentence s/he would have served had s/he been convicted & are eligible to be released u/s 436A Cr.P.C. Reports based on classifications such as type of offence, particular offence/section, period of detention etc.

8 ADVANTAGES The data is calculated on daily basis – thus it is an automated mechanism for daily monitoring. This would help in keeping a check on unnecessary & illegal detention in prison. The offence-punishment database can be updated to include amendments & new laws. It will help maintain a prisoner profile – since various reports based on various criteria can be generated on the click of a button. It will institutionalise the implementation of bail provisions.

9 ADVANTAGES… Data is calculated even if the prisoner has been detained in more than one prison. For example, where prisoners are transferred from one prison to another. Time that person is out on bail is automatically deducted from the total period of detention. It is an automated mechanism to prevent prolonged detention.
