3 The Labour Inspection The L.I. faced: a social problem

The Labour Inspection Today Labour Inspection is a control system organised at worldwide level by the C81 I.L.O. Convention adopted the 11th of July 1947 in Geneva. dott. Andrea Vescio

5 International Labour Organization
control function to secure the enforcement of the legal provisions related to working conditions and the protection of workers;  working hours, wages, safety, health and welfare, exploitation of children, and other connected matters dott. Andrea Vescio

6 International Labour Organization
advisory function to supply technical information and advice to employers and workers concerning the most effective means of complying with the legal provisions; dott. Andrea Vescio

7 International Labour Organization
sanction function to bring to notice to the competent authority of defects or abuses not specifically covered by existing legal provisions dott. Andrea Vescio

8 C 81 – ILO Convention Art.12 empowers the labour inspectors to:
enter freely and without previous notice at any hour, at any workplace; carry out any examination, test or enquiry in order to verify that the legal provisions are being strictly observed dott. Andrea Vescio

9 C 81 – ILO Convention In particular the L.I. are empowered to:
interrogate, alone or in the presence of witnesses, the employer or the employees; require any book, register or other prescribed document related to working conditions; enforce notices required by the legal provisions; take or remove for purposes of analysis samples of materials and substances used or handled dott. 10 C 81 – ILO Convention Art.17 provides the possibility
to prompt legal proceedings to the persons who violate or neglect to observe the enforced legal provisions, leaving to the discretion of labour inspectors to give warning and advice dott. Andrea Vescio

11 C 81 – ILO Convention Art.18 foresees that adequate penalties
for violations of legal provisions enforceable by labour inspectors, and for obstructing labour inspectors in the performance of their duties shall be provided for by national laws or regulations. dott. Andrea Vescio

12 European Union The European Occupational Safety and Health (OSH) legislation; the Senior Labour Inspectors Committee (SLIC) dott. Andrea Vescio

13 European OSH Legislation
Council Directive 89/391/EEC outlines the duties of the employers to guarantee a better level of OSH, the workers to apply safety measures, and the Member States to ensure adequate control and supervision. dott. Andrea Vescio

14 S.L.I.C. Senior Labour Inspectors Committee
95/319/EC Decision The Committee gives its opinion to the Commission on all problems relating to the implementation of Community law on health and safety at work by the Member States. dott. Andrea Vescio

15 S.L.I.C. Senior Labour Inspectors Committee
The Committee assists the Commission in ”defining common principles of labour inspection in the field of health and safety at work, and developing methods of assessing the national systems of inspection in relation to those principles;” dott. Andrea Vescio

The Common Principles of SLIC have been structured in three main sections: overview, relate to the current context of labour inspection in Europe, core principles, concentrating on the implementation and enforcement of the EU legislation, developmental principles, outlining the broader aims of the Community strategy. dott. 17 Labour Inspection The L.I. exercises the functional role of:
the biggest legally commissioned organisation for combating deficits in the safety and health at work places. It thus contributes to prevention of accidents and work-related illness enhancement of safety and health at work acceptance of OSH by society dott. Andrea Vescio

18 Labour Inspection Labour Inspection political role: Authority
third party between employer and worker; for which the collective interest prevails; which guarantees the productive market (fair competition among enterprises) and the labour market (equal rights at work for workers). dott. Andrea Vescio

19 S.L.I.C. Senior Labour Inspectors Committee
The L.I. activities are causing many different consequences effecting the social dialogue, environment safety, labour relations, public contracts, psychological effects of labour, labour police, competition among enterprises, occupational safety and health. dott. Andrea Vescio
