4 1.1 Law on Postal Communications
In April 2016, pursuant to Law on Postal Communications no.36 of , ANRCETI took over the duties of regulation and supervision of the postal service market. Law on Postal Communications, in force since April 29, 2016, sets the main terms and conditions of activity in postal communications, the legal framework for postal service provision and for access to universal postal service, the relations between postal service providers and users of postal services, the rights and obligations of the state, natural people and legal persons in this sector. ANRCETI’s new responsibilities assigned by Law consist in the implementation of the policy documents in the field of postal communications, the general authorization regime for postal service provision, supervision and control of compliance with obligations under the law of the universal postal service provider and with the general authorization conditions, control of the universal postal service provider’ performance and compliance with quality of services standards, examination and resolution of complaints from postal service users, as well as disputes between postal service providers. ANRCETI is also responsible for approving the tariffs for postal services within the scope of the universal postal service BEWG is a regulatory forum of experts to share best practices, share expertise and discussing up-to-date challenges facing EaPeReg and European markets related to regulatory framework and statistical indicators. Promote benchmarking regulatory practices and pave the way for a better comparison tool of electronic communications environment among members Monitor the development of regulatory activities among members – NRA competencies, market analysis, consumer protection, etc. Collect information about key indicators and trends on the telecom sector, in particular for the fixed, mobile (including MTR, STR and FTR) and broadband market Understand how NRAs obtain the information necessary to perform their statistical functions - to exchange know-how on the practical aspects of statistical NRA functions ---- Dissemination of best practices, contributions from BEWG members is essential to the successful benchmarking study performed by the BEWG

5 1.2 Postal Regulations General Authorization in Postal Sector
In accordance with Postal Law any person or entity, registered as an entrepreneur in the Republic of Moldova, who intends to provide postal services, before starting the activity, is required to submit a notification to ANRCETI. It is mandatory that the notification be to submitted by filling in the standard form made and updated by ANRCETI. The standard form for the notification of postal service provision was approved by ANRCETI Administrative Board Decision no.18 of Universal Postal Service Based on Postal Law, every natural or legal person has the right to use postal services within the scope of universal postal service. provides that every natural or legal person has the right to use postal services within the scope of universal postal service. Postal Law establishes the set of services within the scope of universal postal service, the manner of its financing, the requirements and conditions to be ensured by the universal postal service provider in order to provide these services. The methodology for production costs allocation per reserved and non-reserved postal services was approved by ANRCETI Administrative Board Decision no. 24 of Statistical Form for Postal Services Pursuant Postal Law, ANRCETI required, that postal service providers submit statistical information for statistical reports on postal service provision.

6 1.3 Infrastructure Law The Law on access to properties and shared use of infrastructure associated with public electronic communications networks no. 28 of , establishes: • the rules and conditions for access to public or private property for construction (installation), maintenance, dismantling, replacement, transfer or retooling of public electronic communications networks or infrastructure elements necessary for their operation, • method of shared use of physical infrastructure elements situated on, over, in or under public or private property, which can be used for the installation of public electronic communications networks and associated infrastructure for the purpose of installation, maintenance, dismantling, replacement, transfer or retooling of public electronic communications networks and provision of electronic communications services to end users; • method of authorization of construction (installation), dismantling, replacement, transfer or retooling of public electronic communications networks and infrastructure elements associated with those networks. As of April 2016, ANRCETI is empowered by the provisions of Law no. 28/2016 to ensure the compliance with this law by holders of property rights and providers of electronic communications networks and/ or services when obtaining and exercising the right of access on properties and shared use of associated electronics communication infrastructure BEWG is a regulatory forum of experts to share best practices, share expertise and discussing up-to-date challenges facing EaPeReg and European markets related to regulatory framework and statistical indicators. 7 1.4 Infrastructure Regulations
Contract of access Under the provisions of Infrastructure Law, ANRCETI developed and approved in July 2016, the standard contract for access to public or private property for the construction (installation), maintenance, removal, replacement or transfer of existing public electronic communications networks and infrastructure elements. The standard contract developed by ANRCETI is aimed to support both the providers of public electronic communications and the holders of public or private property rights and represents an additional legal guarantee in the stages of negotiating the contracts of access to those properties. The Methodology for calculation of maximum tariffs for the right of access to public properties and/or shared use of physical infrastructure  In force since January 6, 2017, the methodology is intended to facilitate the re-use of physical infrastructure under public property by providers of public electronic communications for installation of network elements by setting a number of single methodological principles for tariff calculation by infrastructure managers. 8 1.5 Market analysis In 2016, ANRCETI identified, analyzed and imposed obligations on 2 relevant markets (3rd iteration): Market 7 - Voice call termination on individual mobile networks. ANRCETI imposed new glide path for MTR based on benchmark. 12 2.1 Market analysis In 2017, ANRCETI plan to identify, analyze and impose obligations on 6 relevant markets (4th iteration): Market 1 - Access to the public telephone network at a fixed location for residential and non-residential customers. Market 3 - Call termination on individual public telephone networks provided at a fixed location. Market 4 - Wholesale (physical) network infrastructure access (including shared or fully unbundled access) at a fixed location. Market 5 - Wholesale broadband access. Market 6 - Wholesale terminating segments of leased lines, irrespective of the technology used to provide leased or dedicated capacity. Market 8 – Wholesale trunk segments of leased lines.
