2 N.J.A.C. 6A:3, Controversies and Disputes
The Department proposes to repeal N.J.A.C. 6A: as it is no longer necessary. The purpose of N.J.A.C. 6A: was to implement the Supreme Court’s remedial orders addressing funding to Abbott districts. In Abbott ex rel. Abbott v. Burke, 199 N. J. 140 (2009) the Court determined that the School Funding Reform Act established a fair and equitable funding formula in conformance with the Constitutional requirements for provision of public education in New Jersey, and therefore declined to continue the status quo concerning enforcement of the Court’s prior remedial orders addressing funding to Abbott districts.

3 N.J.A.C. 6A:9, New Educational Leader Standards
In 2001, the Department adopted the 1996 version of standards set forth by Interstate School Leaders Licensure Consortium (ISLLC) of the National Policy Board for Educational Administration  The ISLLC standards were updated in 2008, but never formally adopted by NJ (though leader effectiveness system components were aligned to the 2008 standards). Today the Department proposes to update the 2015 Professional Standards for Educational Leaders Set forth by the National Policy Board for Educational Administration Considered to be a complete “refresh” of the ISLLC 2008 standards Recommended to be adopted by the State Professional Learning Committee (includes school districts, universities, NJPSA).

4 N.J.A.C. 6A:11, Charter Schools
The Department proposes to repeal N.J.A.C. 6A: , Equity in education, as this requirement is duplicative. Charter schools are included in the scope of N.J.A.C. 6A:7, Managing for Equality and Equity in Education, and N.J.A.C. 6A:7-1.1, Purpose, contains the exact language as N.J.A.C. 6A: The Department proposes to repeal N.J.A.C. 6A: , Financial operations of a charter school, because charter schools are incorporated into specific subchapters of N.J.A.C. 6A:23A, where applicable. A reference to N.J.A.C. 6A:23A in N.J.A.C. 6A:11 is unnecessary. The Department proposes to recodify N.J.A.C. 6A: , Charter school operations, as N.J.A.C. 6A: , to reflect the abovementioned repeals.

5 N.J.A.C. 6A:32, School District Operations
The Department proposes to repeal N.J.A.C. 6A: , Staff tenure and seniority rights, as it is restating the existing legal rights of staff members affected by the withdrawal of the school district, as established through prior State Board of Education and Commissioner of Education decisions. The Department proposes to repeal N.J.A.C. 6A: , Guidance and counseling, as the requirement for districts to provide all students with a program of guidance and counseling services are duplicated in N.J.A.C. 6A:7-1.7(c), 6A:8-3.2, and 6A:
