3 Who is NITAAC? Office of Management and Budget Executive Agent
Housed at Department of Health and Human Services, National Institutes of Health 20+ years experience in information technology (IT) contracting with DoD and other Federal Agencies Last year fulfilled $5B of federal requirements NITAAC’s authority to manage GWACs comes from the Clinger- Cohen Act (40 U.S.C (e)) CMMI certified organization focused on quality and integrity in all processes

17 DFAR /FAR 16.505(b)(1)(ii) The contracting officer may exercise broad discretion in developing appropriate order placement procedures. 16.505(b)(1) Fair opportunity….. The contracting officer must provide each awardee a fair opportunity to be considered for each order….

18 DFAR /FAR 16.505(B)(2) Exceptions to the fair opportunity process The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays. Only one awardee is capable of providing the supplies or services… The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. It is necessary to place an order to satisfy a minimum guarantee…
