3 What is copyright? Copyright protects your work and stops others from using it without your permission.  You automatically get copyright when you create: Original literary, dramatic, musical and artistic work including illustration & photography Original non-literary written work e.g. software, web content and databases Sound and music recordings Film and television recordings Broadcasts Copyright and the LMS with Katy Humphreys & Jason Williams, May 17th, 2017

5 What happens if we breach copyright, or someone breaches my copyright?
An infringement occurs if a “substantial part” of a protected work is copied. This test is of quality, rather than quantity. There are a number of exceptions to infringement of copyright, known as “permitted acts”. If the act does not fall into one of these exceptions, civil and/or criminal remedies are available in respect of an infringement of copyright. 6 Permitted Acts In order to balance the rights of society, or public policy, against the rights of the copyright owners, certain activities are specifically permitted in respect of copyright works. “Fair Dealing” is a term used to describe these acts which allow the use of a copyright work in circumstances that would otherwise infringe copyright: The Permitted Acts relevant to this webinar are as follows: Copyright and the LMS with Katy Humphreys & Jason Williams, May 17th, 2017

8 Top tips and common sense
Do not think that you can use any image from the internet simply because it is in the “public domain”. Check before you use the image whether it is protected by copyright. If you want to use works protected by copyright, can you ask the copyright owner for permission to use it? Check whether we already have a relevant licence to use the copyright works. If you are able to rely on one of the Permitted Acts, make sure that there is sufficient acknowledgement of the author/copyright owner. 9 CC explained – what to look out for
It’s important for all University staff to understand what Creative Commons is. Even if you never create or use any content, at some point you will have almost certainly seen something that looks like the logo above.  If you are putting a PowerPoint presentation together, giving a talk, or uploading materials to the LMS, it’s in your interest to know what those symbols mean. 11 Using photographs and images in the LMS
Using photographs and any digitally re/produced images in your teaching, is a powerful way of helping students to remember content, and to illustrate your point. Linking images to content can work as a very powerful memory devices, as well as illustrating what you are trying to convey. 12 Fair Dealing and appropriate use of images:
use of third-party images should observe fair dealing guidance – lower resolution images or portions of a high resolution image are more likely to be deemed ‘fair’. It would be unlikely to be deemed ‘fair dealing’ to use the whole of a high-resolution image for this purpose. the image can only be used for the purposes of instruction for a non-commercial purpose the image must be accompanied by a sufficient acknowledgement (unless this would be impossible for reasons of practicality or otherwise) this means web links and the name of the creator students and staff are only able to access them via a secure (password-protected) network you can use images from a website under the new exception to the law, but it would be good practice to check the terms of any license that may exist. Any requirement for payment, for example, would imply that usage would not be ‘fair dealing’ Copyright and the LMS with Katy Humphreys & Jason Williams, May 17th, 2017

16 Using Film in the LMS: YouTube/Vimeo
We advise you to err on the side of caution and to use common sense regarding YouTube. Posting links or embedding full-length films would clearly be a bad idea. 17 Using Film in the LMS: BoB and the BUFVC
All staff and students who are registered with the University Library has access and license to use Box of Broadcasts (BoB) and the other British University Film and Video Council (BUFVC). BoB is a repository of over a million TV, Film, and radio programs that we have access to use, embed, and share links to. It also allows to curate your own collections and share them, and to pull different programs from BoB into a single time line to effectively edit your own video. You can embed into the LMS and/or show in the class. Your students are also allowed to use BoB within their course of study, and BoB offers referencing information for the content that makes it easy for students to reference them in their work. 19 Using Film in the LMS: Lecture Capture and myplayer in the LMS
If you show any film/video/DVD/music, etc. you may show film in your class for the purposes of instruction and critique as long as it falls within the realms of fair dealing and/or within the license we have with ERA and BoB. If you that is then captured by the lecture capture system, there should not be any problem. Ensure that correct reference is given to the work. Playing large parts, or all of any work is not permissible if it is captured by lecture capture. myplayer.anglia.ac.uk is the University streaming video service. It is a great place to upload content that you have created, and then embed/post a link to it in the LMS. Do not upload anything to it that you do not have permission to use. 20 Music In the same way as film/video and images, recorded music may not be copied and uploaded to the LMS unless you have been given the right to use it, or you made it yourself. However, you may post links and embed BoB items, you may use YouTube (as long as you use common sense and try to find an official upload), etc. Music must not be used for anything other than instruction pertinent to the course/module, though the link below gives you access to copyright free music that you could use to make things more colorful. We may direct students to Spotify and Google play to find the music. Recent changes in the law mean that teachers may use those services to play their students music within the classroom as long as it is related to what is being taught. 21 Music Sheet Music Sheet music can be be provided through the LMS in small parts to illustrate the teaching - it must not form a substantial part of the work. Contact should be made with the Library over making any items available via reading lists. Teachers will also have to contact the Library for photos copies of sheet music. We can obtain electronic versions (PDFs) of book chapters and journal articles that the library only has in print or does not own. Digitisation is now integrated so lecturers place digitisation requests and students access digitised extracts directly from the module reading list.
