2 Purpose July 2015 – EPA published changes to the 1988 UST Regulation
State Program Approval (SPA) requires adoption of federal requirements No less stringent requirement Incorporating by reference Deletion of past implementation deadlines Editorial and typographical corrections Two additional state-specific requirements

3 New FEDERAL requirements
Three-year implementation timeframe for existing systems: Monthly Walkthrough Inspections Spill prevention and release detection (RD) equipment Annual walkthrough Inspections Containment sumps and hand-held RD equipment Release Detection Equipment Testing (annual) Spill Prevention Equipment Testing (triennial) or use double-walled spill bucket with interstitial monitoring Overfill Prevention Equipment Inspections (triennial) Containment Sump Hydrostatic Testing (triennial) or use a double-walled sump with interstitial monitoring Note: For new systems, the spill prevention testing, overfill inspections, and containment sump testing will be required upon installation.

4 New FEDERAL requirements
Discontinuing use of ball floats for overfill prevention Testing after repairs Compatibility demonstration for biofuel blends Permanent closure of failing tanks with non- repairable internal liners Update Codes of Practice Removal of past deferrals for emergency generator tanks, field constructed tanks, and airport hydrant systems Secondary Containment and Interstitial Monitoring (effective since 2008 based on Energy Policy Act) Notification Requirements (effective since based on EPA Energy Policy Act) Some of the past deferral requirements will have a 2020 implementation deadline, the rest listed will be immediately effective

5 New STATE requirements
Increase record retention timeframe for all records to 3 years Will primarily impact non-GUST facilities Revised deadline for Annual Tank Registration to December 31 (from September 1)
