2 Alternative dispute resolution (ADR) has been utilized by the Florida Court System to resolve disputes for over 30 years, starting with the creation of the first citizen dispute settlement (CDS) center in Dade County in 1975 Rule prescribes ethical standards of conduct for certified and court-appointed mediators.

3 The Florida Dispute Resolution Center (DRC) was established in 1986 to provide staff assistance to four Supreme Court of Florida mediation boards, to certify mediators and to certify mediation training programs. As of October 2016, there were 5,784 individuals certified as mediators. The breakdown by certification is as follows: 2150 certified county mediators 2222 certified family mediators 3298 certified circuit mediators 234 certified dependency mediators 496 certified appellate mediators

4 On October 27, 2016, the Florida Supreme Court adopted proposed amendments to the Florida Rules for Certified and Court-Appointed Mediators in re: Amendments to the Florida Rules for Certified and Court-Appointed Mediators, SC (Fla. 2016). The amendments to the rules change the title of Part III to “Mediation Certification Applications and Discipline” to clarify that this part of the rules pertains to the qualify- cation of applicants as well as discipline.

5 Family Mediators/Circuit Court Mediators
Family Mediators/Circuit Court Mediators. For initial certification as a mediator of family and dissolution of marriage issues, or as a circuit court mediator an applicant must have at least a bachelor’s degree and 100 points, which shall include, at a minimum: (1) 30 points for successful completion of a Florida Supreme Court certified family mediation training program; or 30 points for successful completion of a Florida Supreme Court certified circuit mediation training program (2) 25 points for education/mediation experience; and (3) 30 points for mentorship.

6 Senior Judges Serving As Mediators
Senior Judges Serving As Mediators. A senior judge may serve as a mediator in a court-ordered mediation only if certified by the Florida Supreme Court as a mediator for that type of mediation.

7 Getting additional points:
Education (25 points minimum required): High School Diploma/GED 10 points Associate’s Degree 15 points Bachelor’s Degree 20 points Master’s Degree 25 points Master’s Degree in Conflict Resolution 30 points Doctorate (e.g., Ph.D., J.D., M.D., Ed.D., LL.M) 30 points Ph.D. fm Accredited Conflict Resolution Program 40 points An additional 5 points will be awarded for completion of a graduate level conflict resolution certificate program in an approved accredited institution.

8 Five points shall be awarded to applicants currently licensed or certified in any United States jurisdiction in psychology, accounting, social work, mental health, health care, education, or the practice of law or mediation. Such award shall not exceed a total of five points regardless of the number of licenses or certifications obtained.

9 Continuing Mediation Education (CME)
All certified mediators (mediators) must complete a minimum of 16 hours pf CME in each two year renewal cycle including topics such as mediator ethics, domestic violence education, diversity/ cultural awareness education, mediator skills, etc.

10 At a minimum, fifty percent of the required CME hours must be satisfied by attendance, not as a lecturer or presenter, at a live lecture, live seminar, or an audio/video playback of a seminar attended by a group that discussed the materials presented. Interactive Internet presentations may be counted as attendance at a live lecture. A maximum of four hours of CME may be earned through mentoring as defined above.

11 Mediators who are certified in more than one area must complete 16 hours of CME applicable to each of their areas of certification.

12 Continuing education completed for another profession's continuing education requirement may be used as CME if the material bears directly on the mediator's mediation practice and complies with the CME guidelines.
