SUBJECT :CLARIFICATION TO DENR MEMORANDUM CIRCULAR NO. 2010-14 AND OTHER EIS SYSTEM POLICY ISSUANCES

1. On the Coverage of the ECC Requirement, Section 1 of DENR MC 2010-14, refers to the Revised Procedural Manual for DAO 2003-30 for the listing of types and thresholds of project covered. The following are hereby clarified:

Non-coverage threshold for Funeral Parlors, Cemeteries and Crematoria in Annex 2-1b of the Revised Procedural Manual for DAO 2003-30 is hereby re-adopted setting aside EMB MC 2008-009

Non-coverage threshold of less than or equal to 50-person seating capacity for Fastfood Stores, Restaurant and Similar Quick-Service Establishments is hereby adopted repealing MC 2009-002 and supplementing Annex 2-1b of the Revised Procedural Manual for DAO 2003-30.

Non-coverage threshold of less than or equal to 1 ton maximum storage capacity for LPG Storage and Refilling Station per MC 2010-001 is hereby adopted revising Annex 2-1b of the Revised Procedural Manual for DAO 2003-30

3.Annex 2 referred to in Section 2.2 of the MC is applicable for projects below the threshold of coverage based on the Revised Procedural Manual for DAO 2003-30. For Projects applying for CNC on the basis of its existence prior to 1982, except for gasoline station existing prior to 1996 (w/o any expansion/modification), proof of project commencement preferably documents/certifications issued by relevant government agencies may be required in support of the CNC Application.

4.For projects that has voluntarily undergone scoping prior to the effectivity of the MC, the agreed upon scope of the EIA Study shall be followed provided that the EIA Report is submitted within 3 months from the effectivity of the MC.

5. Technical and public scoping is required for EIS based. The Revised Procedural Manual of DAO 2003-30 will be used for the scoping procedures.

1. On ECC Compliance Monitoring and Reporting Proponents of EIS-based projects issued ECCs prior to DAO 2003-30 shall comply with the new ECC Compliance Reporting frequency and format requirement as well as with the new format for Impact Management and Environmental Monitoring Plan (IMP & EMoP) as per DAO 2003-30

2. On ECC Expiry The temporal validity scope to be specified in ECCs shall be based on the proponents’ application in consideration of EMB’s review of the environmental impacts of the proposed project. ECCs shall not specify expiry dates based on other agencies’ permits such as that of LGU permit for Sand and Gravel (SAG) extraction but rather focus the review on whether the Impact Management and Monitoring Plans (IMP and EMoP) is designed based on the scope of the ECC application.
