2 Toll roads

3 Toll System in the Republic of Slovenia for Vehicles with a Maximum Permissible Weight of up to 3.5 t In accordance with the Road Tolling Act (Official Gazette of the Republic of Slovenia, No. 24/2015), the use of toll roads (motorways and expressways) by a motor vehicle with a maximum permissible weight not exceeding 3.5 t, regardless of the maximum permissible weight of the trailer, is paid by purchasing and applying a valid vignette for the toll class to which the vehicle belongs. Toll Class 1: single-track motor vehicles, with or without a trailer; Toll Class 2A: caravans and two-track motor vehicles with a vehicle height above the first axle of up to 1.3 m and with a maximum permissible weight not exceeding 3,500 kg, with or without a trailer; Toll Class 2B: two-track motor vehicles with a vehicle height above the first axle of 1.3 m or more and with a maximum permissible weight not exceeding 3,500 kg, with or without a trailer.

5 Applying the Vignette Vehicles must have a vignette applied to the prescribed spot when entering a toll road..

7 Sales points In Slovenia, DARS has more than 1,500 authorised sales points (filling stations, retail networks, kiosks, post offices, etc.). The vignettes can also be purchased abroad at approx. 1,200 sales points in 11 countries: Italy, Austria, Hungary, Croatia, Germany, Romania, Czech Republic, Slovakia, Poland, Denmark, and Luxembourg. 14 The toll control is a minor offence authority and has a public mandate to exercise control over toll payment. Minor offence proceedings are conducted in accordance with the provisions of the: Minor Offences Act (“ZP-1,” Official Gazette of the Republic of Slovenia No. 29/2011, as amended); General Administrative Procedure Act (“ZUP,” Official Gazette of the Republic of Slovenia No. 24/2006, as amended); Cooperation in Criminal Matters with the Member States of the European Union Act (“ZSKZDČEU-1,” Official Gazette of the Republic of Slovenia No. 48/2013). 15 A driver using a motorway or expressway without a valid vignette for the appropriate toll class or one not correctly affixed to the vehicle commits a minor offense and is given a fine of EUR 300. A fine of EUR 500 is given to a driver who uses a motorway or expressway without applying the vignette onto the vehicle using its original adhesive or who has tampered with it in order to change or reduce its efficiency. 16 An offender unable to prove their identity or not having a permanent place of residence must pay the fine on the spot if their leaving the scene and returning home abroad gives them the opportunity to avoid paying the fine; in this case, the offender only pays half of the fine, i.e. EUR 150 / 250. If the minor offender does not pay the fine on the spot, the toll inspector issues a decision thereby temporarily depriving the driver of his or her passport, driver's license, vehicle registration, transport documents and other documentation accompanying the goods, securities, means of transport or other movable assets on their person, regardless of whether they are the owner or not. The temporary seizure can last for up to six months and may be extended for another six pending a decision to do so. The minor offender has the possibility of submitting a written appeal against the temporary seizure of the documents within 8 (eight) days. The appeal does not prevent its execution.

17 The temporarily seized documents are returned to the offender on the spot if they pay the fine; if the offender pays the find from abroad, the documents are returned to their embassy in Slovenia, which also issued the documents. The documents are not returned to the offender's home address. The offender may pay the fine from abroad by wiring the amount to the following bank account: IBAN: SI56 0110 0845 0156 488, BIC/SWIFT: BSLJSI2X. Toll inspection

18 LEGAL NOTICE: The offender, their legal representative or counsel, as well as the owner of the seized documents, may lodge a written request for judicial protection within 8 (eight) days following the receipt of the payment order. The request must be sent in Slovene and in 3 (three) copies to Prekrškovni organ DARS d.d., Ulica XIV divizije 4, 3000 Celje. If the court does not grant the offender's request for judicial protection, they are required to pay the fine in its entirety, i.e. EUR 300 / 500, as well as a court fee amounting to EUR 150, levied by the court.
