2 “Safeguarding is everyone’s business” The Home will, through formal and informal procedures, monitor the care of all Residents on a regular and non-discriminatory basis so as to ensure that individual care plans are implemented, maintained and updated and that care is delivered safely and to appropriate and laid down standards. 3 The Home will not tolerate abuse or neglect in any form (either of Residents, employees or anyone connected with the Home) and where abuse is suspected, or witnessed, then immediate action will be taken, as outlined in the following procedure. The Policy Company Limited ©

4 For the purposes of this policy abuse is defined as: “A single or repeated act or lack of appropriate action occurring within any relationship where there is an expectation of trust, which causes harm or distress.” This Policy and Procedure Statement applies to the care of all Residents of the Home. 5 The Home accepts the general presumption that its Residents will have the mental capacity to make informed decisions about their lives. If a Resident, however, has been assessed as not having mental capacity, decisions will be made in their best interests as set out in the Mental Capacity Act 2005 and the Mental Capacity Act Code of Practice. The Home will work with other interested parties (such as its Local Safeguarding Adults Board) in order to determine the very best solutions and achieve the best possible outcomes for its Residents. 6 It is the duty of all employees to report to their Manager any witnessed or suspected incidents of abuse, or any concerns, without delay. Such reports or concerns will be given the highest possible priority, and there will be no delay in considering what action needs to be taken, or advice sought, and from whom. Employees may be assured that their jobs will not be threatened by reporting abusive behaviour by others. The Policy Company Limited ©

7 Any employee who is found to have abused a Resident of the Home will face disciplinary action which may include dismissal, and will be reported to the Disclosure and Barring Service (DBS). Such individuals may subsequently be barred from any future work with vulnerable adults and/or children. The Policy Company Limited ©

8 Procedure Those Residents most in need of safeguarding – Risk Assessment and Risk Management Legislation in England on the subject of safeguarding generally refers to Vulnerable Adults and Children. Adult at risk means adults who need community care services because of mental or other disability, age or illness and who are, or may be unable, to take care of themselves against significant harm or exploitation. The term Adult at risk replaces ‘vulnerable adult’. The Policy Company Limited ©

9 An adult at risk may be a person who :  is elderly and frail due to ill health, physical disability or cognitive impairment;  has a learning disability;  has a physical disability and/or a sensory impairment;  has mental health needs including dementia or a personality disorder; The Policy Company Limited ©

10  has a long-term illness/condition;  misuses substances or alcohol;  is a carer such as a family member/friend who provides personal assistance and care to adults and is subject to abuse;  is unable to demonstrate the capacity to make a decision and is in need of care and support. 11 In the context of Safeguarding Adults, the vulnerability of the adult at risk is related to how able they are to make and exercise their own informed choices free from duress, pressure or undue influence of any sort, and to protect themselves from abuse, neglect and exploitation. 12 The Home undertakes to complete a risk assessment for each Resident in order to assess the potential for abuse, and to take measures appropriate to the situation and circumstances. In some cases Residents may not be in a position to make decisions for themselves, and this will impact in the way that the Home handles many aspects of their care, and a greater appreciation of their increased risk of abuse.
