1 1 GUKEYEH GUK’EH GU’SANI Kaska Dena Government Finance Act Prepared for Presentation to Annual General Assembly August 12, 13 and 14, 2008

2 2 purpose of the Act is to provide for the administration, operation and financial management of the Government Finance Committee be established which will be responsible for the oversight, review and advice to the Council on the administration of the financial affairs for the Government Finance Committee may develop financial procedures to be documented as policy manuals or to be proposed for regulations Finance Chairperson and the Council shall establish a Department of Finance to be responsible for carrying out the day to day financial affairs of the Government and its institutions

3 3 Finance Manager shall prepare financial statements and public accounts for the Government each fiscal year in accordance with Government accounting policies adopted by the Council and transmit the statements and accounts to the Council no later than the 30 th day of June Public accounts must contain the financial statement of the Government as well as a report of the Auditor who are reviewing the financial statements Council shall appoint an Auditor to audit and report upon the financial statements and public accounts Finance Manager shall be hired who will be the senior official within the Department Finance Manager shall ensure the proper collection, receipt, recording and disposition of public money and prepare financial statements and reports

4 4 Finance Committee shall direct the Finance Manager to ensure all Kaska Dena departments, institutions and programs have a monthly review of its financial position as well as the preparation and completion of annual audits if the Finance Manager determines that any department, program or institution is not adhering to the Act or the financial administration, then he/she shall make recommendations to the Finance Committee and the Council and remedial action to be taken in order to carry out the provisions of this Act the Council may obtain professional advice and establish legal entities

5 5 Council may specify the formation of funds or accounts for various purposes including: a.operating fund b.trust c.economic development d.revolving funds e.transition funds Council may establish fund accounts in financial institutions for the deposit of public monies or trust monies the Finance Chairperson shall cause an annual budget to be prepared 30 days in advance of each fiscal year and Council shall approve in advance for each fiscal year an annual budget containing the estimates of revenues and expenditures by department, program, institution or corporation and activity and for goods and services to be purchased in that fiscal year

6 6 Finance Manager to ensure that at least the following items are contained in initial budgets a.summary of budget estimates b.budget expenditures c.listing of financial commitments d.preparation of financial statements e.listings of leases and charges in the provision of services or use of facilities f.estimates of insurance purchases g.revenues from issuances of licenses and leases h.revenues from disposition of property i.procedures by which departments, programs, institutions and corporations shall manage and record financial information

7 7 Finance Committee and Council shall receive all annual budgets submitted by the departments, programs and institutions of the Government budgets will be reviewed and presented to the Council summary of the annual budget shall be made available for inspection by Kaska Dena citizens no payments shall be made from any account or fund unless a requisition for payment has been made in accordance with the Act or any subsequent laws or regulations Council may in the case of an emergency authorize a payment of money from the operating fund that is urgently required for the public even though the money has not been identified in an approved budget

8 8 Finance Manager if authorized by Council may enter into contracts or may delegate to Senior Managers the ability to enter into contracts in accordance with the existing policies or regulations within their department budgets a contract shall not be entered into and is not enforceable against the Government unless entered into by Council, Finance Manager or Senior Manager Finance Committee to ensure establishment and implementation of a system of asset management for all physical assets of the Government Council may establish regulations authorizing the investment of monies no loan of public monies shall be made

9 9 no disposition or loan of public property shall be made to any person except as authorized by a directive of the Finance Committee no money shall be borrowed or security issued by the Government except as authorized by regulation made under this Act in the event of the Government contracting a debt the Finance Manager shall have prepared a Debt Management Plan to be approved as part of its annual budget in the event of a deficit of the operating fund the Finance Manager shall have prepared a recovery plan to be approved as part of the annual budget

10 10 if Council has reason to believe that a person has received public money intended to be provided for the Government, and has not duly accounted for or applied it to that purpose, then the Council must direct the Finance Manager to prepare a written notice requiring such person to return the public money, account for the public money or apply it to its specific purpose any Council member who votes for a National Government Law or regulation to authorizing the expenditure, investment or other use of monies contrary to the Constitution is personally liable to the Government for that amount

11 11 a written complaint may be filed with Council if a Kaska citizen believes that a disbursement, expenditure, liability or other transaction is not authorized by the Constitution or a National Government Law or there has been a theft, misuse, misappropriation or irregularity in the funds, accounts, assets, liabilities and financial obligations of the Government or its institutions upon receipt of a complaint the Council shall direct the Finance Committee to review the complaint and prepare a report if public money is lost or not collected through the misconduct, neglect of duty or negligence of a person responsible for handling public money the person is liable and it may be recovered from him or her as a debt due to the Government

12 12 a Senior Manager commits an offence when in connection with the performance of duties willfully makes or assigns a false entry certificate, requisition, return or other document or if he fails to report knowledge of any fraud which has occurred by someone else the Government has the right to institute any civil or criminal proceedings against the person who contravenes the Act
