25 Security Since the last AGM we are pleased to report that there has not been a serious security incident in the past “18” months. This can be put down to two major reasons :- The ongoing implementation and improvement of the access control system which is being constantly monitored. – Shortfalls such as the service providers phone system being unavailable when they have power outages. This is currently being re-assessed. – Power supply systems at main gate have been improved so that the booms, cameras and lighting are always active thanks to a generator being installed. – A camera system has been installed at the both the sea gates and clubhouse area. The implementation of the twelve hour night time roaming response vehicle linked to the Cell Phone Panic System.

26 Security Areas of Concern Tag system open to abuse. Vandalism at the club house and swimming pool area. The sea gates being held open by bricks. Home owners bringing workers into the complex with out reporting to the main gate for registration. Home owners allowing contractors to roam the estate. Tenants constantly breaking rules. Home owners are responsible for their tenants and will be fined for serious breaches of the Constitution.

27 Security The Future. Tag system being re-assessed. Visitors boom gate to be automated to speed up entry and exit. Although, security has been and is still being improved, we must not get complacent but remain vigilant and aware. The “Kidd’s Beach Gang” are currently behind bars, but there always others that will take their place.

33 GENERAL Constitution Change ANNEXURE A CLAUSE 13.10.3 INDEMNITY A homeowner shall be deemed to have indemnified the Home Owners Association against any claim where the homeowner has contravened any statutory provisions or legislative enactment's which results in the Home Owners Association being in contravention of any valid law. The homeowner shall reimburse the Home Owners Association for any amount which has been imposed against the Home Owners Association as a fine or a penalty notwithstanding the fact that the Constitution of the Home Owners Association may provide for a lesser fine for such contravention. The above provision shall be deemed to include an indemnity against any damages the Home Owners Association may suffer, whether delictually or in terms of common or any other law.
