3 Communication Prior to this afternoon’s hearing, EPD Staff met with Commissioner Brummer to review the staff report and recommendation that is found in your agenda packet. 3

4 Request Applicant requests approval of a permit renewal application to construct, operate, and close, as necessary, a Solid Waste Management Facility consisting of a construction and demolition (C&D) debris disposal facility (landfill). 4

5 Background 5 Located in NW Orange County, west side of Golden Gem Road, approximately 1/2 mile north of Ponkan Road

7 Background Operated as a borrow pit since 1960’s Operated by Hubbard Construction Company as a landfill since mid 1980’s 7

8 Background Construction and demolition debris disposed within excavated areas 8

9 Background Permit approved by BCC in 2000 to expand site from 80 acres to 220 acres (186 waste fill acres) Same airspace is now projected to last through 2093 5 years of post-closure maintenance and monitoring Agreement to Offer Donation of south 120 acres for recreational use Permit extended past Dec 2012 expiration date while permit renewal application being reviewed 9

14 Staff Findings No enforcement actions No substantial deviations from previously approved permit Consistent with latest revisions to Chapter 32 Article V Minor updates to permit conditions to be consistent with latest submittals and code references 14

15 Staff Findings Wekiva Study Area – Solid Waste Ordinance –site is located in Primary Floridan Aquifer Vulnerability Zone (more vulnerable) on default map WSA-5 –presumptive prohibition would normally prohibit a new disposal facility –if no substantial deviation then not subject to new restrictions on siting or setbacks Permit Renewed 2007 Wekiva Study Area Comprehensive Plan Amendments Siting Study 2008-2009 2009 Solid Waste Code Amendments Permit Renewal Application 2011-13 15

16 BCC Action Requested APPROVAL OF RENEWAL OF THE SOLID WASTE MANAGEMENT FACILITY (CONSTRUCTION AND DEMOLITION DEBRIS DISPOSAL FACILITY) PERMIT #SW- 232027-LFCD-85/0712 FOR HUBBARD CONSTRUCTION COMPANY DBA MID-FLORIDA MATERIALS, WITH WAIVERS FOR ABOVE GRADE ELEVATION AND REDUCED LANDSCAPING, AND WITH CONDITIONS, FOR A DURATION OF FIVE (5) YEARS. 16
