Clean Air Act Overview Darrel Harmon U.S. EPA

2 Clean Air Act Overview uWhat we’ll cover –CAA regulatory scheme –NAAQS –Attainment designations uImplementation roles uCAA overview by section

3 CAA Regulatory Scheme uCore program: National Ambient Air Quality Standards (NAAQS) u"Criteria" air pollutants –Anticipated to endanger public health and welfare –Resulting from numerous or diverse sources (contrast w/ air toxics)

4 CAA Regulatory Scheme (cont.) uCriteria Pollutants –Ozone –Particulates –Carbon monoxide –Sulfur dioxide –Nitrogen dioxide –Lead

5 Attainment Designations uAir Quality Control Regions uMonitored NAAQS violation = nonattainment designation uN/A designation triggers prescriptive CAA requirements for state uNonattainment area boundaries identify area with unhealthful air AND area that requires control (in theory)

6 CAA Implementation Roles uCAA relies on STATES for implementation, EPA for oversight (tribes: optional) uSome CAA programs don't easily fit tribal implementation (square peg, round hole) uEPA & tribes must work together, figure how to implement CAA programs designed for states (e.g. TIPs & Title V)

7 CAA Overview by Section uDesignations (Section 107) uAir Quality Criteria (Section 108) uNational Ambient Air Quality Standards (NAAQS – Section 109) uState Implementation Plan Requirements (SIPs – Section 110) uPlan Requirements for Nonattainment Areas (Part D – Sections 171–193)

8 CAA Overview by Section (cont.) uNew Source Performance Standards (NSPS – Section 111) uHazardous Air Pollutants (Title III – Section 112) uPrevention of Significant Deterioration (PSD – Part C – Sections 160–169)

9 CAA Overview by Section (cont.) uEmission Standards for Moving Sources (Title II – Sections 201–234) uGeneral Provisions (Sections 301–327)

10 CAA Overview by Section (cont.) uAcid Deposition Control (Title IV – Sections 401–413) uPermits (Title V – Sections 501–507) uStratospheric Ozone Protection (Title VI – Sections 601–618)
