2 NEW For 2012 There will be one submission in FY 2012 based on the actual appropriated amount. The FY 2012 formula grant award will be disbursed though the Automated Standard Application Payment System (ASAP) operated by the Department of Treasury. NIFA plans to issue all FY 2012 Formula Grants on the NIFA- 2009 form. This form is also used to issue non-formula grants. For formula grants issued in FY 2012, the grantee is required to submit SF-425, however, the grantee is NOT required to submit a quarterly SF-425. The quarterly submission requirement still exists for previously issued grants with DHHS as the designated payment system.

3 Legislative Authority Section 1444 of the National Agriculture, Research, Extension, and Technology Policy Act of 1977 (NARETPA), enacted as Title XIV of Public Law 95-113 (The Food and Agricultural Act of 1977) on Sept. 29, 1977, is also known as the Section 1444 Program. This law provides the basis for Federal funding for agricultural extension activities at 1890 Land-Grant Universities.

4 Purpose of the Program The purpose of the program is to support agricultural and forestry extension activities at 1890 land-grant institutions. Funds appropriated under this section shall be used for expenses of conducting extension programs and activities, and for contributing to the retirement of employees subject to the provisions of the Act of March 4, 1940. No portion of the funds allocated under this grant will be applied, directly or indirectly: - for the purchase, erection, preservation, or repair of any building; - the purchase or rental of land; - or college course teaching; - or any other purpose not specified in NARETPA Section 1444. - Indirect cost and tuition remission are unallowable. - Require an approved plan of work for agricultural extension and research activities at 1890 Land-Grant Institutions to receive Federal funding. Therefore, each 1890 institution must submit a 5-Year Plan of Work update for and an Annual Report of Accomplishments and Results. Both reports were due on April 2, 2012.

5 Funds Carried Forward Section 1444 Program funds are expected to be fully expended in the fiscal year of appropriations, however, no more than 20 % of the funds may be carried forward to the succeeding fiscal year. No prior approval from NIFA is required.

6 Five-Year Plan of Work Update Annual Accomplishments Section 225 of the Agricultural Research, Extension, and Education Reform Act of 1998 (AREERA) amended NARETPA to require an approved Plan of Work for agricultural extension, and research activities at 1890 Land-Grant Universities in order to receive Federal funding. Therefore, each 1890 land-grant institution must submit both a five- year Plan of Work Update for FY 2013-2017 and Annual Report of Accomplishments and Results. Both reports were due April 2, 2012.

7 Eligibility 1890 Institutions are eligible for Section 1444 Program. These institutions may sub-contract to organizations not eligible to apply for funding provided that such arrangements are necessary to complete the project of activity.

8 Matching Include the following in the request: - A request for waiver by grant. - FY for which the waiver is requested. - Exact dollar amount of waiver and how the amount was computed. - Reason for waiver (Natural Disaster, Financial Crisis, and Good Faith Effort). - Documentation supporting the need for a waiver. - Institution’s efforts to meet future matching needs. The documentation should also include: - Institution’s approved budget for the program for the current previous budget cycles. - Other documents such as letters from state or institution or news paper articles.

9 Matching Fund Waiver Request Include the following in the request: A request for waiver by grant. FY for which the waiver is requested. Exact dollar amount of waiver and how the amount was computed. Reason for waiver (Natural Disaster, Financial Crises, Good Faith Effort). Documentation supporting the need for a waiver. Institution’s efforts to meet future matching needs. The documentation should also include: Institution’s approved budget for the program for the current and previous budget cycles. Other documents such as letters from state or institution or news- paper articles.
