1 Proposed LDC Amendment for Bottle Clubs City Council Workshop February 23, 2016

2 Background In early November 2015, about a dozen Palm Coast business owners or residents and the Flagler County Sheriff’s Dept. expressed serious concerns about allowing bottle clubs On November 17 th, City Council approved a resolution establishing a “zoning in progress” On November 18 th, the PLDRB recommended approval to the City Council of an ordinance enacting a 120-day moratorium

3 Background Dec. 15, 2015, City Council enacted 120-day moratorium expiring on April 13 PLDRB at a Jan. 20, 2016 Workshop, after reviewing various options, directed staff to return with an ordinance adding bottle clubs to prohibited uses in our LDC Feb. 17, 2016, the PLDRB reviewed this ordinance

4 Uses Not Permitted in Palm Coast Section 3.01.06 of the LDC provides the foundation for why these uses are not permitted where it states: “This is due to their potential incompatibility with current development trends in the City, their potential deleterious effects upon the public health, safety, and welfare, and the potential likelihood that they will create nuisances and significant adverse impacts upon adjacent land uses.”

5 Comments from Sheriff’s Department Sheriff’s Dept. has an excellent relationship with Volusia County Sheriff’s Dept. and Daytona Beach’s Police Dept. We contacted them regarding a closed bottle club which was frequently in the news over the last few years The closed club was located just outside Holly Hill and Daytona Beach in unincorporated Volusia County Due to its location frequently 2 or 3 agencies responded

6 Comments from Sheriff’s Department Volusia County gave us 17 pages of official records on the bottle club showing: – 453 service calls between Jan. 1, 2013 and Nov. 9, 2015 – Including 44 fights or disturbances and 2 related homicides Bottle clubs are not allowed in Ormond Beach, Daytona Beach and Flagler Beach

8 PLDRB Recommendation On Feb. 17 th, the PLDRB recommended approval of this ordinance making bottle clubs non-permitted uses The City Attorney crafted a revised definition for bottle clubs to help ensure that existing businesses and fraternal organizations would be excluded from the bottle club regulations
