2 Definitions of Status According to the Department of Homeland Security, Alien: is any person that is not a citizen or national of the U.S Non-Immigrant: An alien who seeks temporary entry to the United States for a specific purpose. The alien must have a permanent residence abroad (for most classes of admission) and qualify for the nonimmigrant classification sought. The nonimmigrant classifications include: foreign government officials, visitors for business and for pleasure, aliens in transit through the United States, treaty traders and investors, students, international representatives, temporary workers and trainees, representatives of foreign information media, exchange visitors, fiancé(e)s of U.S. citizens, intracompany transferees, NATO officials, religious workers, and some others. Most nonimmigrants can be accompanied or joined by spouses and unmarried minor (or dependent) children. Permanent Resident Alien: An alien admitted to the United States as a lawful permanent resident. Permanent residents are also commonly referred to as immigrants; however, the Immigration and Nationality Act (INA) broadly defines an immigrant as any alien in the United States, except one legally admitted under specific nonimmigrant categories (INA section 101(a)(15)). An illegal alien who entered the United States without inspection, for example, would be strictly defined as an immigrant under the INA but is not a permanent resident alien. Lawful permanent residents are legally accorded the privilege of residing permanently in the United States. They may be issued immigrant visas by the Department of State overseas or adjusted to permanent resident status by the Department of Homeland Security in the United States

3 What is a lawful status Therefore, Department of Homeland Security (DHS) defines Lawful status as a person in lawful status is “a citizen or national of the United States; or an alien: lawfully admitted for permanent or temporary residence in the United States; with conditional permanent resident status in the United States; who has an approved application for asylum in the United States or has entered into the United States in refugee status; who has a valid nonimmigrant status in the United States; who has a pending application for asylum in the United States; who has a pending or approved application for temporary protected status (TPS) in the United States; who has approved deferred action status; or who has a pending application for lawful permanent residence (LPR) or conditional permanent resident status.

4 ASSET Eligibility  Effective April 29, 2013, eligible undergraduate students include those who do not have lawful presence in the United States but satisfy the following criteria:   Were enrolled for at least three years at a public or private Colorado high school immediately preceding graduation or earning a GED;   Were admitted into a Colorado institution of higher education or attends a reciprocal program within 12 months of high school graduation or earning a GED;   Have a State Assigned Student Identifier (SASID) number in the state of Colorado on file with College Assist;   If the student does not have lawful immigration status, they must also submit an affidavit stating that the student has applied for lawful presence or will apply as soon as he or she is eligible to do so; and,   Are not a nonimmigrant alien.  Additionally, students who graduated from a Colorado high school or completed GED prior to September 1, 2013 and were not admitted into college within 12 months but meet all other eligibility criteria may qualify for the COF stipend by providing documentation to the institution of higher education proving that the student has been physically present in Colorado for eighteen months (18 months) prior to enrolling.,

5 Institutions’ residency classification using ASSET  suggested list of possible resources for a student or institution to access a SASID number before contacting the department includes:   High school transcript,   School website (such as Infinite Campus),   High school counselor or administrator,   School district administrative office, and   Institution of higher education’s institutional research division.  Colorado ASSET links should be helpful  http://www.ciccoloradoasset.org/index.p hp http://www.ciccoloradoasset.org/index.p hp Admissions and Registrar’s office classify student as ASSET to show that student is ASSET Each institution has their own attributes entered in their system Once classification has been determined, school needs to obtain SASID from student If student has not done so already, have them submit affidavit to COF

6 COF  Both ASSET and DACA students can receive COF, we just have to make sure that they filled out the COF application correctly  when submitting the paper application. they tend to fill out the affidavit as well because they usually aren't sure or don’t read the directions completely  On the online application, once they hit no for the citizenship status, they are automatically taken to the affidavit screen. Which is why we tend to have so many students classified as UDA  Which is the 003-010 error code, when you receive this error code on your query files that usually mean that we are missing the SASID from their COF account.  if they are ASSET, the school needs to obtain the SASID  If they aren't classified under ASSET than you would just school verify their residency status and we can get that changed  The 003-009 error just means that the student’s person type is UNK, if they are resident or lawful than their status can be changed based on school verification as well.

7 DACA  DACA is a federal policy and it has other criteria set by the US citizenship and immigrant services department.  Institutions classify DACA student based on whatever criteria you have for your school. 8 Concurrent Enrollment  When the student is still in high school, person type isn't a factor that is looked at  Once they graduate and start college as a regular student, person type needs to be updated if its UNK or if the institution has classified them as ASSET  If student is classified as ASSET, school needs to make sure to update program type from Concurrent/ASCENT to Undergrad and have student submit affidavit forms to COF.
