4 Purpose of Disparity Studies 1.The primary objective is to assess, quantify, and evaluate the prevalence, magnitude, and extent of marketplace discrimination, if any, against minority and women-owned business enterprises (M/WBEs). 2.The Study is necessitated in part by the 1989 U.S. Supreme Court’s decision in the case of J.A. Croson v. City of Richmond for M/WBE Programs that imposed legal requirements on jurisdictions to establish a “compelling interest” to support the establishment or continuation of a M/WBE Programs. 3.New York City’s M/WBE law requires that the City periodically evaluate the availability and utilization of M/WBEs so that the City can make adjustments to goals as appropriate. 4.Timeframe to conduct a study is driven by the scope of services and condition of data.

5 Disparity Study Parameters  The timeframe to conduct the City’s study is 18 months.  Expected completion is in spring of 2017.

6 Anecdotal Data Collection Along with the community meetings, MGT will collect anecdotal data through:  In-depth interviews  Focus groups  Stakeholder interviews  Surveys Anecdotal Evidence

7 Testimony Process  MGT will gather individual comments/feedback from business owners and stakeholders regarding their experiences doing business or attempting to do business with the City or primes contracted by the City.  Individuals who want to provide oral comments today will be called at the end of the presentation to do so at individual stations.

8 Testimony Instructions  During your testimony:  Provide details of your experiences, regarding doing business or attempting to do business with the City or its primes.  Please be specific in your comments regarding entities involved, as well as about time and location for the experiences that you share.  Comments limited to 3 minutes  State and spell your name  State the name of your company
