8 Article 69 of the Montenegrin Constitution provides that everyone has the right to health protection. Children, pregnant women, elderly and persons with disabilities have the right to healthcare from public funds, if they are not covered by another insurance. 10 Chapter 28: Consumer and Health Protection M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Mental Health Reform Development and implementation of mental health policy shall include all the aspects to which the policy directly or indirectly relates: users, their families and their associations providers of primary medical care and specialized mental health care providers, both public and private institutions State agencies and NGOs, especially those NGOs involved in humanitarian work, social protection and mental health. 11 Chapter 28: Consumer and Health Protection M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Goals of the Mental Health Policy Goal 1: Improve and protect the mental health of the population Primary prevention of mental disorders (universal, selective and indicated) and early detection of mental disorders Goal2: To respond to the demands and expectations of service users Increase the quality of services and protect the rights of patients with mental disorders Improvement of legislation related to the protection of the rights of patients with mental disorders and human rights Increasing involvement of users, families and communities in the planning, organization and monitoring of services for mental health. Goal 3: Provide financial protection from the costs of disease Establish mechanisms for the provision of all necessary psychotropic drugs free of charge. Chapter 28: CONSUMER AND HEALTH PROTECTION

12 Chapter 28: Consumer and Health Protection M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union The Law on the Protection and Enforcement of the Rights of Mentally Ill Regulates the way of providing protection and enforcement of rights of the mentally ill, organization and implementation of the protection, and the creation of conditions for the application of measures to protect these individuals from discrimination Mentally ill individuals exercise rights and freedoms in accordance with international instruments and the general rules of international law Prohibits discrimination against the mentally ill Exercise of the rights of mentally ill persons in accordance with this Law may be restricted only in cases prescribed by law which are necessary to protect the health or safety of other persons. Provides that the psychiatrists and other health professionals carry out the treatment of the mentally ill in a way that they to the least possible extent restrict their rights and freedoms and not cause physical and psychological discomfort that offend their personality and human dignity.
