3 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Chapter 30: External Relations Humanitarian and development aid policy – legal and institutional framework Montenegro is a developing country and a development aid beneficiary The existing forms of development and humanitarian aid that Montenegro provides are conducted on the basis of the Constitution of Montenegro and the laws that envisage the possibility of international co-operation, including: Law on Foreign Affairs (Official Gazette of Montenegro 46/210, 6 August 2010), Law on Deployment of Armed Forces of Montenegro Units to the International Forces and the Participation of Members of Civil Defense, Police and Public Administration Employees in the Peace Missions and other Activities Abroad (Official Gazette of Montenegro 61/08, 13 October 2008), Law on Protection and Rescue and Law on the Red Cross of Montenegro from 2006 and relevant international conventions that Montenegro signed.

4 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Chapter 30: External Relations MFAEI – Directorate General for Economic and Cultural Cooperation (DGECC) - building the administrative capacities for implementing the development and humanitarian aid policy; The Government appointed Mrs. Biljana Šćekić a Director General for economic and cultural cooperation on 17 May 2013; Previous co-ordination of donor assistance at the level of the Office of the Prime Minister – Working Group is composed of representatives of all institutions/ministries DGECC will continue to collect data on provided aid, prepare methodology of calculating its value and achieve additional strengthening of the legal framework; Institutional framework

5 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Chapter 30: External Relations Montenegro supports the principles the European Union development and humanitarian aid policy is based on. Montenegro will act upon the principles laid down in the European Consensus on Development, the United Nations Millennium Declaration and political obligations deriving from the Paris principles (2005), Acra Agenda for Action (2008) and Busan Global Partnership for Effective Development (2011). When preparing a legal and institutional framework for implementing the development and humanitarian aid policies, the experiences of the member states will also be taken into account. 6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Chapter 30: External Relations Millennium development goals and post 2015 – Mid – term report on implementation of MDGs adopted in 2010 – one of recognized goals is ``to provide global partnership for development``. Considering the fact that in 2010 Montenegro did not have the candidate status, one of indicators for measuring fulfillment of goals was measuring of use of available IPA funds. After 2015, the year envisaged for implementation of MDGs, Montenegro is planning development of new indicators, which would reflect legislative and institutional framework for donor aid of Montenegro to other countries, and which would be harmonized with relevant EU policies. Ownership over aid coordination – overtaking responsibility Synergetic effect between different policies Examples of the existing development aid Financial contribution of USD 1.2 million for development of Afghanistan National Security Forces (ANSF) 2015-2017 Donation of USD 10.000 for construction of elementary school for girls in Pol-e - Khomri province, Afghanistan Development aid

7 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Chapter 30: External Relations Montenegro is supporting principles on which the EU development aid is rested Following the accession to the EU, Montenegro is ready to transfer expert knowledge and experiences from particular areas to other countries with similar interests, comparative advantages (small state, flexible administration and adaptable system) The existing mechanism for construction of capacities in the region of Western Balkans (ReSPA). As an earlier beneficiary of bilateral development aid, following the accession to the EU, Montenegro will continue to develop bilateral cooperation under the same principle

8 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Chapter 30: External Relations The Government of Montenegro is considering the options for strengthening institutional capacities for implementation of development cooperation and humanitarian aid policy Institutions included in this policy MFAEI, MSDT, Ministry of the Interior – Department for Emergency Situations and Civil Security, MLSW– Refugee Care and Support Office Humanitarian aid donor on ad - hoc basis (from 2008 to 2013 – Syria, Pakistan, Sierra Leone, Palestine) The existing forms of humanitarian aid provided by Montenegro are conducted in accordance with the Law on the Red Cross (2006) and manual MANUAL SPHERA – UN The Ministry of the Interior is coordinating preparation of the amendments to the Law on Protection and Rescue, and it should integrate certain provisions of the Law on Humanitarian Aid. Montenegro is participating in restoration of consequences of some accidents. Therefore, so far, the Red Cross of Montenegro provided support to the Red Cross of Albania (explosion of weapons), the Red Cross of China (earthquake, Sichuan province), the Red Cross of Haiti (catastrophic earthquake) and the Red Cross of Japan (earthquake, tsunami), Serbia (earthquake) Humanitarian aid

Montenegro showed interest in participation in the EU mechanism for civil protection Procedure initiated regarding membership into the Union programme (preparation of memoranda, assessment of financial participation) Formal entrance in the course of 2014 Refund of financial ``entry – ticket`` through IPA partly – NIPAC We acquire the possibility for participation in implementation of numerous projects Participation in this program will contribute to development of capacities of Montenegrin administration for participation in humanitarian actions – civil protection Further development of institutions and capacities

10 Exchange of information, logistics support, access to services of the Monitoring and Information Centre (MIC) and the Common Emergency Communication and Information System (CECIS) Through the accession to mechanism, we will agree on the issue of sending and reception of humanitarian aid due to civil emergency situations (all under Chapter 27 – Environment) It is necessary to prepare the concept Host Nation Support (support of the host country) which is already owned by majority of Member States and Candidate States into the Mechanism, and which define in details procedures related to sending and reception of humanitarian aid Chapter 30: External Relations M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Further development of institutions and capacities

11 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 30: External Relations Chapter 30: External Relations Cooperation with non – governmental and international organizations The Red Cross of Montenegro is communicating with the national society, embassy of Montenegro in the appropriate country and MFAEI in order to assess the situation and necessary action The Red Cross and network of their organizations are achieving necessary cooperation HELP and UNHCR – refugees and displaced persons in order to take care of them in the refugee camps World Vision, Misione Acrobaleno,... CARITAS
