3 3 Wolfgang Pointner Legal Acts Federal law to establish a central purchasing body (BBG) –It was issued to establish a central purchasing body in Austria, –regulating the aims of this central purchasing body –regulating the obligation to cooperation between federal contracting authorities and BBG –organisational issues Accompanying regulation –issued by the ministry of finance, defining goods and services which have to be purchased centralized by the central purchasing body (BBG).

4 4 Wolfgang Pointner EU directive 2004/18/EC – Art 1 (10) Art 1 (10): Definition –A ”central purchasing body” is a contracting authority which: –acquires supplies and/or services intended for contracting authorities, or –awards public contracts or concludes framework agreements for works, supplies or services intended for contracting authorities.

5 5 Wolfgang Pointner EU directive 2004/18/EC – Art 11 Art 11: Public contracts and framework agreements awarded by central purchasing bodies 1. (Task) –Member States may stipulate that contracting authorities may purchase works, supplies and/or services from or through a central purchasing body. 2. (Presumption of Compliance) –Contracting authorities which purchase works, supplies and/or services from or through a central purchasing body in the cases set out in Article 1 (10) shall be deemed to have complied with this Directive insofar as the central purchasing body has complied with it.

6 6 Wolfgang Pointner Reasons to establish a Central Purchasing Body Former decentralisation of public procurement in Austria led to: –different methods, procedures & standards –different products within administration units –loss of synergies –the market power of public administration was used ineffectively Substantial loss of public resources!
