4 Request for Information from the DOL Business Existence Committee A copy of at least one document from each of the categories below will be required in order to register PROOF OF FEDERAL EMPLOYER IDENTIFICATION NUMBER(FEIN). Documentation from IRS noting assignment of FEIN Federal or State tax return (only acceptable with a pre-printed label) or a pre-printed tax coupon Documentation from employer’s financial institution showing employer’s FEIN PROOF OF BUSINESS ENTITY Certificate of good standing Articles of incorporation Certificate of Existence Business License State registration Official and/or government documents PROOF OF PHYSICAL LOCATION (Please use a document issued within the last 12 months) Tax records Lease or mortgage agreements Utility bills Other documents proving physical location 4

5 PERM Drafting Considerations  Have I accurately defined the employer, work location, job duties and actual minimum requirements of the job opportunity?  Have I set client expectations regarding impact of preference category?  Which O*NET occupation do job duties most closely align with? See http://www.flcdatacenter.com/http://www.flcdatacenter.com/ Supervisory duties and travel requirements may increase wage level.  Do minimum requirements exceed SVP for the occupation and, if listing alternative set of requirements, is SVP substantially equivalent to primary set? Consider impact of foreign degree equivalency and on the job training  Are there any audit triggers? 5

12 12 Recruitment Requirements Recruitment must take place 30-180 days before PERM application filed Placement of job order with SWA Placement of two Sunday newspaper ads General circulation Spaced at employer’s discretion (but not same day) If position requires experience and an advanced degree, one Sunday ad may be replaced with one ad in a professional journal Professional journal must be in print, cannot be on the internet only

13 13 Additional Recruitment Steps for Professional Positions (not including College or University teachers selected in a competitive selection and recruitment process as provided in 20 C.F.R. § 656.18) Choice of 3 out of 10 possible additional recruitment steps for professionals: Employer’s website Job fairs Job search websites Private employment agencies On-campus recruitment Trade or professional organizations Employee referral program (if incentives are offered) Campus placement office postings Local and ethnic newspapers, where appropriate Radio and television ads …

14 14 Elements of the Advertisement Must contain the employer’s name Must direct applicants to report to or apply to the employer Must describe the job opportunity Must indicate the geographic location of the job opportunity The wage is not required, but if wage is included in the ad, must equal or exceed prevailing wage (and cannot be less favorable than the wage offered the foreign national)

15 15 Notice & Posting Requirements Employer must post a notice of the job opportunity at the worksite for 10 consecutive business days, unless position is unionized, including all requirements for print advertisements, and: Posting must include salary; Posting must contain notice language and address of Certifying Officer in Atlanta. Must also post via all in-house media normally used to recruit for similar positions (e.g., intranet, electronic, bulletin board)

16 Applicant Assessment Employer driven process, must document applicant assessment in Recruitment Report (See 20 CFR 656.17(g)) Lawful, job-related reasons for rejection include:  Applicant is not a “U.S. worker”  Failure to meet minimum requirements  Cannot be trained within a reasonable period of on the job training to acquire lacking skills  Failure respond to interview requests or attend interview  Poor work references or references cannot be checked  Refusal to take test or poor performance of test normally required by the employer  Withdraws job application  Unwillingness to accept wage offered  Unwillingness to relocate, if required 16
