4 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine The Common Fisheries Policy (CFP) A Common Fisheries Policy (CFP) was first formulated in the Treaty of Rome (1957) Initially linked to the Common Agricultural Policy, over time it has gradually become more independent Comprehensive Common Fisheries Policy since 1983 A new Common Fisheries Policy from 1 January 2014 It aims to establish long-term environmental, economic, and social sustainability of fishing and aquaculture activities

(d) the conservation of marine biological resources under the common fisheries policy" Article 3(2) TFEU: "The Union shall also have exclusive competence for the conclusion of an international agreement when its conclusion is provided for in a legislative act of the Union or is necessary to enable the Union to exercise its internal competence, or in so far as its conclusion may affect common rules or alter their scope."

(d) agriculture and fisheries, excluding the conservation of marine biological resources"

Member States have to implement legally binding Union acts (Article 291 TFEU) Acquis Communautaire – which is binding for every new member of Community (currently, more than 1.400 legal acts) The acquis in the Chapter Fisheries consists of regulations, which do not require transposition into national legislation It is subject to continuous expansion and change

Unlike directives, which are addressed to the Member States, and decisions, which are for specified recipients, regulations are addressed to everyone A regulation is directly applicable, which means that it creates law which takes immediate effect in all the Member States in the same way as a national instrument, without any further action on the part of the national authorities It requires the introduction of measures to prepare the administration and the operators for the implementation of the Common Fisheries Policy rules

12 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Regulation (EC) No 1100/2007 establishing measures for the recovery of the stock of European eel It establishes measures for the recovery of the European Eel stock, the abundance of which was at a historical low level and in constant decline at an alarming rate It obliges MS with river basins in their national territory that constitute habitats for the eels, to establish and implement eel management plans

13 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine A plan may contain measures, such as reducing commercial fishing activity, restricting recreational fishing, restocking measures, structural measures to make river passable and improve river habitats, transportation of silver eel from inland waters, combatting predators, measures related to hydro- electric power turbines, aquaculture, as well as any other measure necessary for the achievement of the 40% escapement target The implementation of the EMPs is assessed by ICES (International Council for the Exploration of the Sea) and STECF (Scientific, Technical and Economic Committee for Fisheries)

19 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Regulation No 762/2008 on the submission by MS of statistics on aquaculture MS shall submit to the Commission statistics on all the aquaculture activities conducted in freshwater and saltwaters on their territory MS shall use surveys or other statistically validated methods covering at least 90 % of the total production by volume, or by number for the production of hatcheries and nurseries The remaining part of the total production may be estimated (if above 10%, a request for derogation may be submitted)

21 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Council Regulation (EC) No 708/2007concerning use of alien and locally absent species in aquaculture MS shall ensure that all appropriate measures are taken to avoid adverse effects to biodiversity (…) which may be expected to arise from the introduction or translocation of aquatic organisms and non-target species in aquaculture and from spreading of these species into the wild MS shall monitor and supervise aquaculture activities MS shall designate the competent authority (…) responsible for ensuring compliance with the requirements of the Regulation

22 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Aquaculture operators intending to undertake the introduction of an alien species or the translocation of a locally absent species shall apply for a permit from the competent authority MS shall keep a register of introductions and translocations containing historical record of all applications made and the documentation gathered before the issue of a permit and during the monitoring period The register shall be made freely available MS have to set up a website accessible via Internet in order to share with other MS relevant information included in the registers (Commission Regulation (EC) No 535/2008)

MS are required to compile a wide range of biological and economic data It covers commercial fisheries by EU vessels (incl. outside EU waters), recreational fisheries (salmon and eel), (marine) aquaculture, industries processing fisheries products, impact of fishing on ecosystem Questionnaires used for socio-economic data

30 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Implementation A separate chapter on data collection in the EMFF Operational Programme (funding strategy, administrative arrangements) Information on data collection need to be provided in some of the horizontal sections such as section 2 (SWOT analysis and identification of needs) and section 6 (Fulfilment of ex ante conditionalities) Each MS is required to set out the national programme of work they will undertake (detailed technical requirements) Every year Member States report on their delivery of the National Programme for the previous year

31 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Land-locked countries Currently no obligation to implement DCF -but collection under the Eurostat Structural Business Statistics regulation -may benefit from the EMFF funding for data collection in the fields of aquaculture and processing For land-locked countries who plan to use EMFF for data collection, the EMFF Monitoring Committee to include a data collection contact point (or national correspondent for the coastal states)

33 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Revision of the DCF: Scope of the DCF, among others Once DCF is revised: - Socio-economic and sustainability data for freshwater aquaculture (if included in revised DCF) - Socio-economic data only for the processing industry - Only if either is present in their territory MS can familiarize themselves with the sort of data they would need to collect under the future framework (Commission Decision 2010/93/EU (Appendices X, XI & XII))

34 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Further steps: To include a clause into the negotiation position about exemption from collecting and transmitting of socio-economic data on the aquaculture and fish processing sectors and recreational fisheries (salmon and eel) AND To follow the developments in adoption of a Commission proposal for a revised Data Collection Framework regulation that is currently being prepared, and adjust the position paper accordingly and ensure all necessary preparations (data collection programme, amendments of the EMFF OP, designation of data collection contact point, amending the Monitoring Committee)

40 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Control of marketing (art. 56) Each MS shall be responsible for controlling on its territory the application of the rules of the CFP at all stages of the marketing of fisheries and aquaculture products, from the first sale to the retail sale, including transport Where a minimum size has been fixed for a given species in Community legislation, operators responsible for purchasing, sell­ing, stocking or transporting shall be able to prove the relevant geographical area of origin of the products MS shall ensure that all fisheries and aquaculture products from catching or harvesting are put into lots prior to the first sale

42 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Traceability (Art. 58) Without prejudice to Regulation (EC) No 178/2002, all lots of fisheries and aquaculture products shall be traceable at all stages of production, processing and distribution, from catching or har­vesting to retail stage MS shall ensure that operators have in place sys­tems and procedures to identify any operator from whom they have been supplied with lots of fisheries and aquaculture prod­ucts and to whom these products have been supplied Detailed rules for the application of this Article shall be adopted

46 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Regulation 1005/2008 establishing a Community system to prevent, deter and eliminate illegal, unreported and unregulated fishing It establishes a Community catch certification scheme It applies to EU MS and third countries wanting to trade fish with the EU It applies to all marine fishery products obtained from catches, processed or not Some products are excluded (aquaculture products obtained from fry or larvae, freshwater fish) EU publishes non-cooperating countries list

52 Project funded by the European Union Projekat finansira Evropska unija Project implemented by Projekat sprovode Republika Srbija Ministarstvo poljoprivrede i zaštite životne sredine Content of the Operational Programme An analysis of the situation in terms of the strengths, weaknesses, opportunities and threats and the identification of the needs that require to be addressed in the geographical area The analysis shall be structured around the relevant Union priorities A description of the strategy (selection of relevant measures, setting up the targets, the assessment of the specific ex ante conditionalities, a list of criteria applied for selecting the fisheries and aquaculture areas, implementing arrangements, etc.)
