Legal and Regulatory guidelines and helpful hints

Choosing words carefully helps minimize risk GE Legal reviews promotional material: For compliance with applicable laws To assesses claims to ensure they are fair and balanced, accurate, precise, substantiated, and supported by data To ensure compliance with intellectual property, copyright, and trademark requirements are met For risk identification and issue spotting GE RA reviews promotional material: To make sure nothing is false or misleading To make sure product features, claims and functionality are on label and in line with its intended use To make sure ad/prom is in sync with product registrations and labeling You may make format, cosmetic or grammatical changes without having it re-approved. If you change the content, message or add pages, legal and RA will need to re-approve.

Pitfalls to avoid Avoid hyperbole Avoid absolute language Do not use real patient data Do not make comparative claims between GE and competition

Alternate Language AvoidBetter Ensuring patient safety; Safe Enable provider to enhance patient safety Reducing medical errorsEnable provider to reduce medical errors Integrate, integration, embedded Tightly connected, connectivity, interface Improve financial performance, maximize revenue or collections, cash flow Optimize revenue cycle efficiencies, help optimize profitability Full suiteBroad suite or offering Better or best decisions, better/ best care More informed decisions or care UniqueDistinctive, exceptional AvoidBetter The best, ideal, betterExceptional, contributing to optimal The strongest, onlyA best of breed The world leaderA world leader, a leading provider, among the top All or alwaysGenerally DestroyErode, diminish, impact Allowing, ensuring, makingSupporting, facilitating, enhancing, or enabling Leads to higher patient satisfaction Contributes to higher patient satisfaction Improve health outcomes, improve patient care & quality Improve efficiency, convenience, and accuracy; enhance patient care/quality

Alternate Language AvoidBetter Privacy Requirement Compliant (Ex. 42 Use of Integrated vs. Interoperable/Interfaced Use of “Integrated” As a industry direction – “Integrated Care”Ok to use As a title of a organization or an individual’s title – “Integration Engineer,” “Integration Services” Ok to use Describing our products as being integrated on the front end. Ok to use. Be specific by adding “view” and “workflow” -“Integrated VIEW” or “Integrated WORKLOW.” Describing our products as being integrated together on the backend. Giving the impression two distinct products are one and the same. Incorrect usage. Replace with “interface”, ”seamlessly connected,” “tightly connected” or “connectivity” or “interoperable.” EMR IntegrationTerms like this can have 2 meanings. If its used as general industry term and description of a service, then its it OK to say “integration”. If it is being used to specifically describe our product’s connectivity to another products, use “interface/connectivity” verbiage.

Special GE disclaimer language If any of the following circumstances exist for your collateral, you will need additional disclaimer language in a prominent place within your collateral.  Product Disclaimers  Future functionality/Roadmaps/Vision Statements  Demos  ROI  Meaningful use attestation http://libraries.ge.com/foldersIndex.do?entity_id=38081881101&sid=101&SF=1 Disclaimers can be obtained at this link

Trademarks/copyrighted products When non-GE products are named/referenced, those names and logos are trademarks of their respective owners. Review GE’s contract with the non-GE entity – including a GE customer - to see if GE has permission to refer to the product/customer. If GE doesn’t have a contract with the non-GE entity, refer to the company’s website for guidance on use of brand and/or trademarks. If there is no specific guidance in the contract or on the company’s website, then add: “All other product names and logos are trademarks of their respective owners.”

3 rd Party Trademark Rules 45 Each reference to a product must include the appropriate trademark and copyright symbols It is not sufficient to include the marks on the first reference in the document. The only exception to this is with GE product names. Centricity™ is to be used in the first reference in a document. Subsequent references do not require the trademark Never use abbreviations Example Internet Explorer® should always be spelled out. IE is not to be used. Disclaimers should only include products referenced in the body of the document Example, if you only include iPhone, the disclaimer should read "iPhone is a registered trademark of Apple Inc., registered in the U.S. and other countries." When multiple products from a single company are reference, they can be combined in the disclaimer Example: Mac, iPhone, iPad are registered trademarks of Apple Inc., registered in the U.S. and other countries.
