Inspector General System

Determine the state of the command’s economy, efficiency, discipline, morale, mission performance, training and readiness as directed by the commander (AR 20-1). Statutory Authority is Title 10, U.S. Code, Section 3020 Mission Statement

ANSWER: Everything for which the commander is responsible for and over which the commander has Federal authority Inspector General Pretest

 An extension of the Eyes, Ears, Voice and Conscience of the Commander  On the CG’s personal staff  Fact finders - Impartial, objective & thorough  Confidential  Available to anyone (Soldiers, family members, or civilians requesting help)  Advisors  Detailed What We Are

The authority of the IG comes from the Commander!  IGs have no directive authority outside the IG System and cannot inspect or investigate without the Directing Authority’s written approval  IGs do not establish command policy except for AR and AR 20-1  IGs have access to all needed materials and records except for classified material (if the IG lacks the proper clearance) or as specified in paragraph 8-4 g (material related to the attorney-client relationship, communications with clergy, husband-wife communications, doctor-patient communications, etc.) What We Are (cont.)

 We are not policy makers  We are not SJA  We are not Private Investigators  We are not an appellate authority Court-martial; UCMJ; OERs; NCOERs Discharge: type received or pending; Relief for Cause Enlisted Reductions; Reports of Survey; Claims Adverse information filed in personnel records Redress available to DOD civilians through other channels What We Are Not

 Comprised of four basic Inspector General functions: Inspections Assistance Investigations Teaching and Training  Inspectors General execute this system through two basic processes: The Inspections Process The Inspector General Action Process (IGAP) The U.S. Army IG System

 Anyone may submit a request  Encourage Soldiers to first use the chain of command  Handle at the lowest level  Use other agencies  Close the loop with client Assistance

 Usually violations of Standard of Conduct or UCMJ  Authority from Commanding General  Fact finding – fair and impartial  Assess facts, draw conclusions and make recommendations  Only used as basis for adverse action with approval of TIG Investigations

 Compare to the Standards  Identify Root Cause Don’t Know Can’t Comply Won’t Comply  Teach and Train  Fix responsibility for corrections  Spread the good news Inspections

 IG Records are protected and governed by specific rules set forth in AR 20-1, Chapter 3.  All IG Records belong to the Secretary of the Army.  The designated release authority for all IG Records is The Inspector General of the Army.  Most information gathered by an IG performing any IG function becomes an IG Record.  IG Records are redacted for all attribution before release for official use. IG Records

IG Records & How They Are Used  IG Records are protected and governed by specific rules set forth in AR 20-1, Chapter 3.  Kept for 30 years  Post Board Screening Drill Sergeant Recruiter Sergeant Major Battalion / Brigade Command General Officer Nominative assignments Black Ops assignments

 Confidentiality and discretion are core concepts for IGs  Complainants expect confidentiality  Confidentiality = safeguarding identities (nature of the complaint and protection against reprisal)  Intent = Protect privacy Maintain confidence in the IG system Minimize the risk of reprisal PROTECT  IG’s duty is to PROTECT confidentiality IAW AR 20-1  Confidentiality is never guaranteed!
