WHAT IS OVERBOOKING? Overbooking exists when there are confirmed or compromised more seats than available, in order to compensate for the non-show or breaches of contract and thus to achieve the maximum possible occupation.

AIR OVERBOOKING AND LAW In Spain, the OVERBOOKING is governed by Regulation EC 261/2004 *, established by the European Parliament and of the Council on 11 February 2004. Important information for the affected passengers: Passenger who is denied boarding is entitled to the refund of tickets or re-routing under satisfactory conditions and to receive appropriate care (maintenance and accommodation if required). The right to compensation for overbooking air extends to all flights with departure or arrival at a Community airport, where the air carrier is community. It affects both regular flights, and not regular and package tours. Air carriers are required to ask volunteers before denying boarding to passengers that they themselves select against their will.

AIR OVERBOOKIND AND LAW Compensation for overbooking are: Flights up to 1,500 km: € 250 Flights between 1500 and 3500 km: 400 euros Flights over 3,500 km: 600 euros The air carrier may be reduced by 50% these compensation if it offers affected passengers the ability to be driven to the final destination on an alternative transport with a difference in time of arrival of between two and four hours maximum.

EXAMPLE OF OVERBOOKING IF YOU ARE AN AFFECTED CONSUMER, YOU MUST KNOW THESE OPTIONS: Request for passengers not boarding (Art. 4, 8) The airline will be the seek volunteers who are willing to give up their reservations in exchange for benefits that will be freely agreed between the carrier and the passenger volunteer. Forced rejection of shipment and means of compensation (Art 7,8,9,12) There is no volunteer or that these are insufficient to boarding to other passengers with reservation, the carrier proceeds to forced rejection of shipment, in which case should financially compensate.

OVERBOOKING AND LAW To claim you must follow the following steps: SHEET OF CLAIMS Through sheets of claims that the airlines should have available at the information desks or points of sale of tickets at airports. NO RESPONSE If you receive no response, or this be not satisfactory can file a complaint with AESA (State Agency for air safety) free of charge. AESA’S INFORM AESA will analise the information which the ask to airline to the applicant and the airlines, the actions carried out in connection with the claim and issue a report with the result of their actions.
