WHAT IS OVERBOOKING? Overbooking exists when there are confirmed or compromised more seats than available, in order to compensate for the non-show or breaches of contract and thus to achieve the maximum possible occupation.

AIR OVERBOOKING AND LAW In Spain, the OVERBOOKING is governed by Regulation EC 261/2004 *, established by the European Parliament and of the Council on 11 February 2004. Important information for the affected passengers: Passenger who is denied boarding is entitled to the refund of tickets or re-routing under satisfactory conditions and to receive appropriate care (maintenance and accommodation if required). The right to compensation for overbooking air extends to all flights with departure or arrival at a Community airport, where the air carrier is community. It affects both regular flights, and not regular and package tours. Air carriers are required to ask volunteers before denying boarding to passengers that they themselves select against their will.

EXAMPLE OF OVERBOOKING IF YOU ARE AN AFFECTED CONSUMER, YOU MUST KNOW THESE OPTIONS: Request for passengers not boarding (Art. 4, 8) The airline will be the seek volunteers who are willing to give up their reservations in exchange for benefits that will be freely agreed between the carrier and the passenger volunteer.
