4 Historic Preservation 101 Historic preservation is a professional endeavor that seeks to preserve, conserve and protect buildings, objects, landscapes or other artifacts of historic significance under the National Historic Preservation Act (NHPA). NHPA directs federal agencies to accomplish two primary tasks: –Take into account the effects of their actions on historic properties –Provide the ACHP a reasonable opportunity to comment ACHP administers the NHPA’s Section 106 review process and works with federal agencies to ensure compliance with their Section 106 responsibilities and to help improve how they consider historic preservation values in their programs. Section 106 applies to historic properties that are listed in or eligible for listing in the National Register of Historic Places. Section 106 is a framework for problem solving, grounded in consultation, while providing stakeholders access to federal decision-making. Results of Section 106 consultation range from full preservation to total loss of historic properties.

5 Historic Preservation 101 Compliance DOE must ensure that its WAP, SEP, and EECBG recipients are compliant with Section 106 of the NHPA, consistent with DOE's 2009 letter of delegation of authority regarding the NHPA. DOE worked with the ACHP and NCSHPO to develop a prototype Programmatic Agreement (PA), to assist in streamlining Section 106 reviews, to date 39 PAs have been executed between DOE and states, with additional ones pending.  Each state can only have one PA; EECBG, SEP and WAP state agencies, SHPO, and DOE must be signatories  The PA is applicable to all recipients and subrecipients in the state Recipients (or subrecipients) are required to retain sufficient documentation to demonstrate that the recipient (or subrecipient) has received required approval(s) from the SHPO or THPO for the Project, or that the activity will not adversely affect an historic structure or site.

6 Historic Preservation 101 Sufficient Documentation Sufficient documentation includes, but is not limited to: –If Exempt Activity under PA: Spreadsheet or paperwork providing: (1) name of building, (2) Address, and (3) Reason exempt under PA –If not Exempt Activity, or State does not have a PA: Need to look at the specific state requirements to show compliance with Section 106 (each circumstance will be unique) –Items to look at: (1) Interagency Agreement Requirements, (2) Procedures outlined in the PA, (3) State Statutes, (4) State SHPO requirements, and (4) any MOA. –Some form of documentation that shows consultation with the SHPO, THPO, and DOE if applicable. –Retain any information that the SHPO requests –Documentation of the final determination (how the Section 106 process was resolved).

7 Historic Preservation 101 Defining Activity For the annual report, the form uses the term activity. An activity refers to: individual undertakings that comprise a project funded in whole or in part by U.S. DOE through EECBG, WAP, or SEP. –An Individual task completed at each building is a separate activity. Most of the time if all the work is at one building then that would be one activity. However, if some of the work is exempt and some of the work is not, then two separate activities would need to be reported accordingly. –Activities also must be separated based on funding source. If WAP is providing funding for a building for insulation and EECBG is also providing funding for lighting at the same building, this would be two separate activities.
