The Law Code of Hammurabi

“Hammurabi, the king of righteousness am I” …Marduk [the chief god] sent me to rule over men, to give the protection of right to the land… to bring about the rule of righteousness in the land, to destroy the wicked and the evil- doers; so that the strong should not harm the weak; to further the well-being of mankind.

Hammurabi’s Code The following are situations Hammurabi faced. How would our society deal with the problem.

What should be done to the carpenter who builds a house that falls and kills the owner? Hammurabi decrees in law 229 If a builder builds a house for a man and does not make its construction sound, and the house which he has built collapses and causes the death of the owner of the house, the builder shall be put to death.

What should be done with a thief or someone who buys stolen goods? Hammurabi decrees in law 6 If any one steal the property of a temple or of the court, he shall be put to death, and also the one who receives the stolen thing from him shall be put to death.

What happens if a man is unable to pay his debts? Hammurabi decrees in law 117 If a man be in debt and is unable to pay his creditors, he shall sell his wife, son, or daughter, or bind them over to service. For three years they shall work in the houses of their purchaser or master; in the fourth year they shall be given their freedom.

What should be done with looters? Hammurabi decrees in law 25 If fire break out in a house, and some one who comes to put it out cast his eye upon the property of the owner of the house, and take the property of the master of the house, he shall be thrown into that self-same fire.

How is the truth determined when one man brings an accusation against another? Hammurabi decrees in law 2 If any one bring an accusation against a man, and the accused go to the river and leap into the river, if he sink in the river his accuser shall take possession of his house. But if the river prove that the accused is not guilty, and he escape unhurt, then he who had brought the accusation shall be put to death, while he who leaped into the river shall take possession of the house that had belonged to his accuser.

What happens in a medical malpractice suit? Hammurabi decrees in law 218 If a physician make a large incision with the operating knife, and kill him, or open a tumor with the operating knife, and cut out the eye, his hands shall be cut off.

What should be done in a case of burglary? Hammurabi decrees in law 21 If any one break a hole into a house (break in to steal), he shall be put to death before that hole and be buried.

What happens in a divorce case? Hammurabi decrees in law 141 If a man's wife, who lives in his house, wishes to leave it, plunges into debt, tries to ruin her house, neglects her husband, and is judicially convicted: if her husband offer her release, she may go on her way, and he gives her nothing as a gift of release. If her husband does not wish to release her, and if he take another wife, she shall remain as servant in her husband's house.
