California’s Electronic Waste Recycling Program SB 20/50: An Update on the CEW Collection & Recycling System Implementation CIWMB E-waste Group

Purpose of Today’s Item Update on our implementation efforts: Status of fee collection and BOE activities Status of collector and recycler approvals Status of recycler payment claims. Summarize the stakeholder workshop held April 8th 2005 Describe challenges we expect to face in the coming months.

Intent of Act Provide financial relief to Local Jurisdictions Provide cost-free recycling opportunities for consumers throughout the state Reduce and eventually eliminate the stockpile of waste computers/TVs Reduce/Prevent illegal dumping Decrease amount of hazardous materials in covered products

Fee Collection Began January 1, BOE Currently 3,300 registered retailers – representing over 11,000 locations Big players/majority of market share participating 1 st quarter returns expected to be lower than other quarters Will receive funds mid-May

Collectors and Recyclers 204 approved collectors 32 approved recyclers/dual entities Approval good for 2 years Recyclers submit payment claims along with collection documentation CIWMB pays recyclers; recyclers pay collectors

Assistance to Stakeholders All forms and instructions available on line Conference calls with all claimants Workshop April 8 th Individual meetings with recyclers Guidance material and sample completed forms distributed and available on line Formal letter explaining insufficiencies in the claim Opportunity to “fix now” to avoid future problems and potential appeals

Status of Payment claims 21 claims received from 14 recyclers For $1.8 M and 3.9 M pounds We have begun processing payments Of claims submitted more than 3 weeks ago, we’ve thoroughly reviewed and given formal feedback to 73% We’re awaiting additional documentation from claimants to approve, adjust or deny

E-Waste Recycling Program Material & Cash Flow

Payments Distribution of recovery and recycling payments to qualified (approved) entities to cover the cost of collection and recycling. Eligible activities began January 1, Only properly documented covered electronic wastes (CEW’s) collected from CA sources after start date are eligible for payment. Payments are limited to recycling (cancellation) activities that occur in-state.

California Source “California Sources” of CEWs are consumers, as defined in Section (d) of the Public Resources Code, located in California who generate CEWs after their own use of the CEW. California sources may include, but are not limited to the business sector, residential sector, local government, state government, schools and other institutions within the borders of California. Entities who take, further handle, consolidate, store, or otherwise deal with discarded, donated or collected CEWs are not California consumers, or California sources. (14 CCR (a)(11))

Payments Collectors and recyclers must offer a “cost-free and convenient” collection opportunity as a condition of payment. Collectors and recyclers prohibited from charging for service if State payments cover costs. Initial combined recycling payment rate is $.48 per pound of material cancelled (includes $.20 per pound recovery payment which must be passed on to Approved Collector). CIWMB may revise the payment amount every two years as necessary.

Responsibilities Under The Act An Approved Collector is entitled to receive $.20 per pound for CEWs transferred to an Approved Recycler if the Collector: Tracks sources of CEWs and only transfers CEWs generated from CA sources for payment. Submits required collection documentation to approved Recycler(s) An Approved Recycler may claim $.48 per pound of CEWs cancelled in a manner approved by the State if the Recycler: Is inspected by DTSC and be found to be in conformance with all applicable laws. Submits claims for eligible CEWs, including supporting documentation, to CIWMB as specified in regulation.
