Institute for Sustainable Development and International Relations 27 rue Saint-Guillaume – Paris Cedex 07 - France J. Rochette, IDDRI Analysis of the Croatian legal framework in face of the Mediterranean ICZM Protocol's provisions Regional MedPartnership Workshop on harmonizing the national legal and institutional framework with the ICZM Protocol Zagreb, Croatia, 4-5 December 2012

Introduction Background Step 2 of the ProtoGIZC project Analysing to what extent national legal systems comply with the provisions of the Protocol Croatia as the first case study Identifying the legal reforms needed for Croatia to be fully compliant with the Protocol Methodology Mission in Croatia, May 2010 (Zagreb, Zadar, Split) Desk work: analysis of the Croatian legal framework Help from experts: Marijana Mance, Nataša Kačić-Bartulović and Martina Sorsa, from the Ministry of Environmental Protection, Physical Planning and Construction, Croatia Draft report presented to Mediterranean (Split, May 2011) and Croatian (Zagreb, October 2011) experts Review by PAP/RAC

Introduction Challenges and limits Challenges EU screening report on the Croatian legal system not in public access Legal texts not all translated in English Case law not available A purely legal analysis Examination of the legal compatibility between the Croatian law and the Protocol In certain fields, particularly challenging to assess the implementation of the provisions solely in light of the legal framework (integration mechanisms, regional cooperation…) Effective implementation of legal provisions and effective integration of the coastal management system not checked Main conclusions

Introduction Outline 1.A well-developed national legal framework 2.A ICZM Strategy yet to be elaborated 3.Governance issues 4.Conclusion

1. A well-developed national legal framework Since the 2000s, development of the environmental law in the framework of the accession to the EU Legal texts adopted in order to transpose the Community acquis Major texts: Nature Protection Act, 2005: principles of nature protection, protected areas… Environmental Protection Act, 2007: environmental protection principles, protection against pollutions, institutional arrangements, information and participation… Physical Planning and Building Act, 2007 (last amendement in 2012): system of physical planning and building, creation of the “coastal protected area”… Islands Act, 1999 …

1. A well-developed national legal framework Conclusion: compliance with most of the Protocol’s provisions Specific recommendations regarding Article 8-2 (see I. Trumbic)

2. An ICZM Strategy yet to be elaborated Article 18 of the ICZM Protocol: “Each Party shall further strengthen or formulate a national strategy for integrated coastal zone management” No existing ICZM Strategy Not compliant with Article 18 of the Protocol An ICZM Strategy to be elaborated

2. An ICZM Strategy yet to be elaborated 2009 Strategy for Sustainable Development Special attention to the “Protection of the Adriatic Sea, Coastal Area and Islands” Calls for the elaboration of an “Integrated Coastal Management Strategy” Article 49 of the EPA Elaboration of a “Marine Protection Strategy”, Containing developments on ICZM A National ICZM Strategy to be adopted As a self-standing document Or as a section of a broader document

3. Governance issues Information, participation and right to legal recourse: compliant Integration mechanisms: Impossible to assess the compliance in light of the sole legal texts (see R. Billé) At least, the legal framework does not seem to prevent the implementation of provisions Challenges in terms of institutional coordination for ICZM Pilot administration for ICZM implementation? See I. Trumbic

Conclusion A well-elaborated legal framework Compliance with most ICZM Protocol provisions A National ICZM Strategy to be elaborated However: It does not mean that coastal management is actually integrated (see R. Billé) Many challenges remain: urban sprawl, illegal urbanisation, tourism, institutional coordination…
