EPOCA – 11. June Intellectual Property Definitions : Background = pre-existing knowledge Foreground = knowledge generated during the project Collaborative projects ► Access rights to another participant’s Back- or Foreground needed to fulfill its own work or/and use the generated knowledge

June Access rights (1) * Access rights to Background Acces rights to Foreground project implementation mandatory access? yes, if a participant needs them to carry out its own work under the project (GA art. II CA art ) condition royalty-free (GA art.II.33.2; CA art 9.3-4) * use (exploitation, further research) mandatory access? yes, if a participant needs them for using its own Foreground (GA art. Access rights (2) EPOCA – 13. June Any Request for access rights shall be in writing The requesting party must show that Background and/or Foreground is needed (ie needed to carry out its own part of work under the project or to use its own Foreground)
