New Superintendents Meeting Employee Contracts & Labor Relations Jason Hancock SDE Deputy Chief of Staff July 30, 2012

SB Employee Contracts Phasing out tenure – no new grants of tenure for those who don’t already have ID tenure. New Category A & B contracts replace old Category 1, 2 & 3 contracts. Category A contract is a 1-year contract with no property rights attached. Can let a Category A employee go at the end of the school year – must provide evaluation prior to non-renewal decision and written reasons for non-renewal.

SB Employee Contracts Category B contract is a 2-year contract with no property rights attached. MAY be given to those who have completed at least three years of experience. Can let a Category B employee go at the end of the second school year – must provide evaluation prior to non-renewal decision and written reasons for non-renewal. Must also provide an informal review with the board, if requested by employee. May add a year to contract at end of first year.

SB 1108 – Labor Relations Eliminate “evergreen clauses” from all Master Contracts. Limit length of Master Contracts to one year. Negotiations on Master Contract limited to salaries and benefits. “Benefits” limited to employee insurance, leave time and sick leave. Union must prove each year that it represents at least 50% of employees for collective bargaining to take place.

SB 1108 – Labor Relations All labor negotiations must take place in public. If collective bargaining fails by June 10, board imposes its last, best good faith offer by June 22.

SB 1108 – Other HR Issues Parent input must be included as a part of certificated, building-based employee evaluations. How much and how is up to you. Can no longer use seniority or contract status as a factor in layoff decisions. Eliminated Early Retirement bonuses.
