COPN Budget Language The Secretary of Health and Human Resources shall convene a work group that shall include health care providers, consumers of health care services, representatives of the business community, and other stakeholders to review the current certificate of public need process and the impact of such process on health care services in the Commonwealth, and the need for changes to the current certificate of public need process.

Revisiting COPN What is the public good? Is COPN working? If not, what needs to be fixed? How do we define the public good if COPN is kept?

Three Aspects of COPN Statute Regulations or State Plan Process and Procedures o Are they fair? o Are they open and transparent?

A Different Environment Healthcare environment is changing Commercial market changes Expanded coverage through federal exchange and other ACA-related changes Scenarios with and without Medicaid expansion

How did we get here? 1964 – COPN first adopted by New York 1973 – Virginia enacts COPN program 1974 – Federal law passed encouraging states to adopt COPN programs 1987 – Gov. Baliles establishes a COPN study commission 1988 – Federal law allowed to expire 1989 – Partial deregulation approved; postponed in – Joint Commission on Health Care study 2000 – JCHC report on deregulation; rejected by 2001 General Assembly 2010 – HJR 27 directs JCHC to study indigent care

Workgroup Goals Review COPN process in Virginia, exploring whether there’s a need for change Consider criteria for decisions Evaluate how COPN process affects new health care services Examine relationship between COPN and charity care Examine COPN’s effects on medical education and teaching hospitals Look at regional health planning agencies’ role in COPN, and consider updating State Medical Facilities Plan
