GAC-GNSO Consultation Group On GAC Early Engagement in GNSO PDP London Progress Report 22/06/2014

Background The GAC-GNSO Consultation Group is established to address the issue of GAC early engagement in GNSO PDP The issue was identified by both ICANN Accountability and Transparency Review Teams: –ATRT1 Rec. 12 –ATRT2 Rec. 10.2

Work Track I (Team 1) Mechanism for day-to-day ongoing cooperation Identified 6 potential opportunities: A.GNSO Liaison(s) to the GAC B.GAC Chairs / GNSO Chairs regular interaction C.Topic Leads / Buddy System D.Rethinking recurring joint meetings / conference calls E.Further develop / expand early awareness & notification notices F.Group of existing GNSO Council PDP liaisons interacting with the GAC Initial proposal focuses on options A, F & E

A. GNSO Liaison to the GAC Description: GNSO Liaison to the GAC Appointed by the GNSO Council Most likely, an outgoing or recently departed GNSO Councilor Implemented as a pilot Evaluated after one year Secured funding for FY15 (i.e. starting LA)

A. GNSO Liaison to the GAC Responsibilities: Attend and participate in GAC meetings Represent and communicate GNSO policy work Work closely with GNSO Chair and Vice Chairs Liaise with ICANN policy staff in the preparation of briefing materials and/or responses to questions Liaise with relevant working groups, utilizing GNSO Council liaisons where required Provide regular updates to the GNSO Council Guide the GAC in opportunities for early engagement Keep the GAC updated on how its early input was considered by the GNSO Assist in facilitating GAC-GNSO discussions in cases where GAC early input is in conflict with GNSO views

A. GNSO Liaison to the GAC Practical Working: Attend all GAC open meetings and be allowed to request the floor Attend GAC closed meetings discussing GNSO related topics and be allowed to request the floor Attend GAC conference calls by invitation and accordingly be allowed to request the floor Join GAC WGs by invitation and accordingly be allowed to request the floor Will not be on the GAC mailing list but may send to it through the mailing list admin and receives replies by being cc’d

A. GNSO Liaison to the GAC  Seek to obtain GAC and GNSO – Approval to proceed with this option starting LA meeting – Approval of detailed specificationdetailed specification

F. GNSO Council PDP Liaisons Description: Group of Existing GNSO PDP Liaisons Typically participate in GNSO WG deliberations Experts in the different GNSO ongoing policy activities Have a seat on the GNSO Council Will Primarily support the GNSO Liaison to the GAC May interact directly with the GAC if necessary / desirable

GNSO Council PDP Liaisons How this works in practice: A mailing list of GNSO Council PDP WG liaisons could be created to flag certain items that should be brought to the attention of the GAC Regular calls could be scheduled between the GNSO Council PDP WG liaisons and the GNSO liaison to the GAC

F. GNSO Council PDP Liaisons  Seek to obtain GAC and GNSO support to move ahead with this option as it provides support for the GNSO Liaison to the GAC

E. Early Awareness/Notifications Notifications are currently sent by GNSO Secretariat to GAC Secretariat and/or GAC Chair Documents are then posted on the GAC website and GAC members notified Notifications are often lost in the multitude of s GAC members receive Alternative mechanisms could be explored to go beyond a simple “heads up” Further feedback / input from the GAC is desirable in order to expand on this option

E. Early Awareness/Notifications An on-line survey for GAC memberson-line survey Objectives of the survey are: – To inform GAC members of existing opportunities to engage in GNSO PDP – To understand GAC views regarding the timeliness and overall utility of existing mechanisms whilst aiming to develop improvements This option will be further reviewed following the results of the survey

E. Early Awareness/Notifications  Seek participation in the survey from GAC members in order to best inform the work of the Consultation Group

Work Track II (Team 2) Mechanism for GAC early engagement in GNSO PDP Studying the 6 phases of the current GNSO PDP: 1.Issue Scoping 2.Initiation 3.Working Group 4.Council Deliberations 5.Board Vote 6.Implementation Initial proposal focuses on early phases 1 & 2

Objective Make GAC aware of all existing mechanisms available to provide input into the GNSO PDP Enable GAC to provide input in a timely / meaningful way If/when GAC decides to provide input, have a common understanding of what the potential impact of such input is (e.g. on the PDP timeline as well as WG/Council response) Develop a mechanism which is manageable and sustainable taking into account number of PDPs ongoing as well as desire for effective and timely policy development

PDP Phases Diagram Current focus of deliberations Includes request and publication of preliminary Issue Report for public comment, as well as GNSO Council consideration of whether to initiate a PDP and development of PDP Charter

Phase 1: Issue Scoping Existing Engagement Opportunities: – Any Advisory Committee can request an Issue Report – Publication of Preliminary Issue Report (drafted by Staff) for public comment

Phase 2: Initiation Existing Engagement Opportunities: – If PDP is not initiated on issue requested by AC, option to request reconsideration (not used to date) – If DT is formed to develop charter, call for volunteers (open to anyone interested)

Ideas being explored Review outcome of survey to establish whether early PDP engagement communications are known / work GAC ‘Quick look’ mechanism to establish whether issue has potential public policy implications and flag as such at early stage Additional support to allow GAC to provide timely input Ensure that any GAC positions / advice are included in the Preliminary Issue Report GAC Triage committee
