Competition on downstream markets) Access to network infrastructure can be justified as a means of increasing competition Price control is necessary when market analysis in a particular market reveals inefficient competition

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 5 EU Telecoms Regulatory Status Directive 19 Interconnection (ctd) Where a NRAs impose obligations to implement a cost accounting system in order to support price controls, they may themselves undertake an annual audit to ensure compliance with that cost accounting system The EU Commission needs to know which undertakings have been designated as having significant market power and what obligations have been placed on market players by NRAs To establish a harmonised framework for the regulation of access and interconnection, measures have to be taken at Community level to achieve Directive 19 objectives

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 7 EU Telecoms Regulatory Status Directive 20 Authorisation (ctd) It covers authorisation of all electronic communication networks and services whether they are provided to the public or not, so that both categories of providers may benefit from objective, transparent, non-discriminatory and proportionate rights, conditions and procedures It only applies to the granting of rights to use freqencies where such use involves the provision of an electronic communications network or service, normally for remuneration.

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 8 EU Telecoms Regulatory Status Directive 20 Authorisation (ctd) Allows the provision of electronic communications networks and services in order to stimulate the development of new electronic communications services and Pan-European communication networks and services, and to allow service providers and consumers to benefit from the economies of scale of a single market Best achieved by general authorisation of all Communication networks and services without any explicit decision or administrative act by the NRAs and by limiting any procedural requirements to notification only

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 10 EU Telecoms Regulatory Status Di rective 20 Authorisation (ctd) Where the demand for radio frequencies in a specific range exceeds their availability, appropriate and transparent procedures should be followed for the assignment of such frequencies in order to avoid any discrimination and optimise use of those scarce resources The penalties for non-compliance with conditions under the general authorisation should be commensurate with the infringement Member States may need to amend rights, conditions, procedures, charges and fees relating to general authorisations and rights of use where this is objectively justified

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 11 EU Telecoms Regulatory Status Directive 21 Regulatory framework for electronic communications networks and services The convergence of the telecommunications, media, and information technology sectors means all transmission networks and services should be covered by a single regulatory framework In accordance with the principle of separation of regulatory and operational functions, Member States should guarantee the independence of the national regulatory authorities with a view to ensuring the impartiality of their decisions National regulatory authorities need to gather information from market players in order to carry out their tasks effectively

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 12 EU Telecoms Regulatory Status Directive 21 Regulatory framework (ctd) NRAs should have a harmonised set of objectives and principles to underpin, and should, where necessary, coordinate their actions with regulatory authorities of other Member States in carrying out their tasks under this regulatory framework The requirement for Member States to ensure that national regulatory authorities take the utmost account of the desirability of making regulation technology neutral, i.e. it neither imposes nor discriminates in favour of the use of a particular type of technology

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 13 EU Telecoms Regulatory Status Directive 22 Universal Service (Excerpts) Provision of a defined minimum set of services to all end-users at an affordable price (cost to be recovered in a competitively neutral way) Certain obligations apply to all providers of publicly available telephone services at fixed locations, providers of significant market power and universal service operators are subject to all obligations Network termination points are boundaries for regulatory purposes and are the responsibility of the national regulatory authorities Services are to be rendered with the quality specified to all end-users at an affordable price

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 14 Directive 22 Universal Service (ctd) EU Telecoms Regulatory Status Users are eligible to fundamental requirements of universal service with connection to the public network at a fixed location, at an affordable price. Network providers are to comply with such requirements. Affordable price means a price defined by Member States at national level, also with respect to low-income users. National regulatory authorities are to require publication of quality of service performance. On the basis of subsidiarity, national regularity authorities are to decide which operators have universal obligations for this Directive‘s purposes

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 15 Directive 22 Universal Service (ctd) EU Telecoms Regulatory Status Where necessary, Member States are to establish mechanisms for financing the net cost of universal services if operator service obligations can only be provided at a loss. Net costs are to be calculated on the basis of transparent procedures. The net cost of universal service obligations may be shared between all or certain specified classes of undertakings/operators. Universal service obligations are to ensure that certain technological choices are not promoted above others. Mobile operators with significant market power are to enable their subscribers to access the services of any interconnected provider.

Nov/Dec 2003ElectraNet BSP-2 Workshop (khb) 16 EU Telecoms Regulatory Status  National regulatory authorities are to systematically survey the quality of services offered in their territories, to allow comparability between service providers and Member States  All EU users have access to a single emergency telephone number 112.  Number portability is a requisite for the consumer in competitive environment.  Numbering resources shall be available to all end-users.
