Guidelines for Conducting Training and Procedures Reporting Safety Loss Loss Control Committee Meetings

Open Records/Open Meetings We are operating under the premise that the Best Government is an “Open Government” – that is why ND is an Open Records State. The North Dakota Supreme Court summarized the purpose of the open records law shortly after its enactment: What the Legislature was attempting to accomplish was to provide the public with the right and the means of informing itself of the conduct of the business in which the public has an interest, in order that the citizen and taxpayer might examine public records to determine whether public money is being properly spent, or for the purpose of bringing to the attention of the public irregularities in the handling of public matters. To serve this important public purpose, these open records provisions should be construed liberally in favor of the public’s access to information.

Open Records / Open Meetings In 1997 steps were taken to ensure proactive loss control efforts do not create paper records that could be prejudicial to the State during litigation. The 1997 Legislature enacted statutes that provide certain risk management records and certain loss control committee records and meetings are PRIVILEGED and EXEMPT from the State’s open records and open meetings laws. (N.D.C.C. § ) Unless otherwise provided by law, all meetings of public or governmental bodies, boards, bureaus, commissions, or agencies of the state or any political subdivision of the state, or organizations or agencies supported in whole or in part by public funds, or expending public funds, shall be open to the public.

Loss Control Committee Meetings Loss Control Committee Meetings: These are considered open meetings. Every person has the right to attend any open meeting. Every person also has the right to enforce open meeting laws if violated. Open Meetings Laws Are Enforced By: a. Administrative Review by the Attorney General’s Office b. Civil Actions c. Criminal

Notices of Open Meetings There are several statutory requirements for conducting open meetings. One of the first requirements is giving proper “notice” of the meetings. Guidelines for giving proper notice are found in N.D.C.C. § : Public notice must be given in advance of all meetings (but does not need to be published); Notice must have: date, time, location of meeting, and general subject matter of any executive session expected;

Notices of Open Meetings Guidelines continued: Annually file (January) the schedule of the meetings with the Secretary of State – list date, time, location; Post copy in agency’s office (bulletin board) when members of committee notified and at location of meeting on day of meeting; and If meeting is rescheduled, new notice must be provided.

Exemptions From Open Meetings Law Exemptions must be specifically provided by law: If records are ‘exempt’ or ‘confidential’, the portion of the meeting to discuss those records is called the “Executive Session”, which is closed to the public. The rest of the meeting must be open. This is where LCCs should review Risk Management Fund loss run reports, reserves, incident reports, investigation reports of specific or reasonably predictable claims to determine root cause of the incident or claim.

Exemptions From Open Meetings Law Continued: Documentation distributed for discussion in the executive session needs to be collected at the end of the session and shred at the end of the meeting.

Conducting Executive Sessions The procedures for conducting executive sessions are specified by law: 1. Convene in open session following proper public notice; 2. Announce during open portion the topics to be considered during executive session and the legal authority for holding session on those topics (N.D.C.C. §§ and ); 3. Pass a motion to hold an executive session;

Conducting Executive Sessions Procedures continued: 4. Record the executive session electronically or on audio or video tape and retain for one (1) year; 5. Limit topics considered during executive session to the announced, authorized topics; and 6. Take action during the open portion of meeting to revise policies or procedures as a result of reviews conducted in executive session. (Report in the open session and document in the Minutes what actions will be taken, i.e. more training, revise a policy).

Conducting Executive Sessions Minutes: Minutes of executive session/closed portion of meeting should not be taken (but the fact an executive session was held must be recorded). Minutes of the open portion of meeting must reflect: members attending executive session; date and time called to order and adjourned; summary of general topics discussed that does not disclose any closed or confidential info.; and the legal authority.

Conducting Executive Sessions Sample Language –  Documenting Executive Session: Motion was made by member’s name and seconded by member’s name, that the Committee enter into the “Executive Session”, (closed meeting), electronically recorded … Motion carried. Time _______ a.m./p.m. “Executive Session” Authority N.D.C.C. §§ and All members named above were in attendance for the Executive Session: ______________________________. Workers Compensation Loss Control Reports and Risk Management Division reports containing updated information since the date of last meeting were reviewed. A motion was made by member’s name and seconded by member’s name that the “Executive Session” be closed. Motion carried, “Executive Session” closed at ______ a.m./p.m.

Conducting Executive Sessions Sample Language –  Documenting “No” Executive Session: Since there were no Workers Compensation or Risk Management claims or incident activity to discuss in Executive Session, it was the general consensus to forgo the Executive Session and continue the open session of the Loss Control Committee Meeting.
